HomeMy WebLinkAboutOrdinance #1628 ORDINANCE NO. 1628 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING ARTICLE 831 OF CHAPTER 83 TO PRO- VIDE FOR THE ADOPTION BY REFERENCE OF THE UNIFORM MECHANICAL CODE, BEING VOLUME II OF THE UNIFORM BUILDING CODE, 1970 EDITION The City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The Huntington Beach Ordinance Code is hereby amended by amending Sections 8311 and 8312 to read as follows : 8311. ADOPTION OF THE UNIFORM MECHANICAL CODE (UNIFORM BUILDING CODE, VOLUME II, 1970 EDITION) . There is hereby adopted by the City Council of the City of Huntington Beach for the pur- pose of protecting public health and safety by prescribing mini- mum standards for the use , design and installation of heating, ventilating, . comfort-cooling equipment and refrigeration systems , and requiring a permit and inspection for the installation, al- teration and replacement of said equipment, providing for the ad- ministration and enforcement of such requirements and prescribing penalties for violations thereof, the Uniform Mechanical Code, being Volume II of the Uniform Building Code , 1970 edition, com- piled by the International Association of Plumbing and Mechanical Officials and International Conference of Building Officials, and repealing all ordinances and parts of ordinances in conflict therewith EXCEPT Sections 8313 and 8314 thereof, by reference, of which code not less than three (3 ) copies have been and now are filed in the office of the City Clerk of the City of Huntington Beach, and the same and the whole thereof, including the appendix of the Uniform Mechanical Code standards and fees specified there- in, is hereby adopted and incorporated as fully as though set out at length herein, as provided by Section 50022 . 2 et seq. of the Government Code of the State of California, and from the date of this ordinance shall take effect and the provisions thereof shall be controlling within the corporate limits of the City of Hunting- ton Beach. 8312 . PERMIT FEES . Section 304 of the Uniform Mechanical Code , 1970 edition, is hereby amended by adding thereto the fol- lowing words and figures : 1 . NEW CONSTRUCTION, RESIDENTIAL, SINGLE OR MULTI- FAMILY . Every applicant for a permit to install, add to, alter, relocate or replace a heating system, appliances , comfort-cooling system or any part thereof, shall state in writing on the appli- cation form provided for that purpose , the character of work pro- posed to be done and the amount and kind in connection therewith, together with such information pertinent thereto as may be required. Such applicant shall pay for each permit , at the time of is- suance , a fee in accordance with the above schedule, and at the rate provided for each classification shown therein. Fees for new construction, residential, single or multi- family, including all heating and comfort-cooling installations , shall be determined by applying the following formula to the square footage of the area. FORMULA: one-half cent (Z ) per square foot of dwelling area plus $3 for each permit . Where duct work is being done under separate contract then the permit fee for duct work shall be One Dollar ( $1) for residential unit plus Three Dollars ($3) for each permit . Fees for special inspection or investigation to determine code compliance on any items in the above schedule shall be charged per hour, or fraction thereof, at the rate of Five Dollars ( $5 ) per hour . The fees for any installation for which a permit is required but for which no fee is herein provided, shall be based on the valuation of the proposed work and shall be as stated in Table 3A of the Uniform Building Code , 1970 edition, as amended. The fee for plan checking shall be one-fourth (4) of total heating and comfort-cooling permit and shall be paid at the time the plans are submitted to the Building Official . Any person who shall commence any warm-air heating, ventila- tion, comfort-cooling work or refrigeration for which a permit is required by this code without first having obtained a permit there- for, if subsequently permitted to obtain a permit , shall pay double the permit fee fixed by this section for such work, with an addi- tional charge of Ten Dollars ($10 ) . Provided, however, that this provision shall not apply to emergency work when it shall be proved to the satisfaction of the Administrative Authority that such work was urgently necessary and that it was not practical to obtain a permit therefor before the commencement of the work. In all such cases , a permit must be obtained as soon as it is practical to do so, and if there be an unreasonable delay in obtaining such permit , shall pay a double fee as herein provided with an additional charge 2 . of Ten Dollars ($10 ) . REFUND OF FEES . When construction authorized by a permit is not begun and no inspections have been made , the Director of Building and Safety shall, upon written request from the per- mittee , make refund of fees subject to the following limitations : No refund of fees shall be made of the basic permit fee cost of Three Dollars ($3 ) . No refund of fees or any part thereof shall be made unless ap- plication for refund shall be made within 120 days from date of is- suance of such permit . SECTION 2 . This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News , a weekly newspaper of general circulation, printed and published in Huntington Beach, California. PASSED AND ADOPTED by the City Council of the City of Hunt- ington Beach at a regular meeting thereof held on the 16th day of February 1971 .
