HomeMy WebLinkAboutOrdinance #1740 ORDINANCE NO . 1740 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR CHANGE OF ZONING ON REAL PROPERTY LOCATED ON THE SOUTH SIDE OF ELLIS AVENUE BETWEEN HUNTINGTON AVENUE AND THE SOUTHERN PACIFIC RIGHT OF WAY (ZONE CASE NO. 72-8) WHEREAS, pursuant to the Conservation and Planning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Case No. 72-8 wherein both bodies have carefully considered all information presented at said hearings , and after due con- sideration of the findings and recommendations of the Planning Commission and all evidence presented to said City Council, the City Council finds that such zone change is proper, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The following described real property, located on the south side of Ellis Avenue, extended between Huntington Avenue and the Southern Pacific Railroad right of way, is hereby changed from M2-01 and M2-0, Heavy Industrial District, " com- bined with oil production, to Rl, "Single-family Residence Dis- trict : " Being a portion of Lots 1 and 10 of Tract No . 37 as shown on map recorded in Book 9, page 34 of Mis- cellaneous Maps , records of the County of Orange , to- gether with a portion of the southeast quarter of Section 35, Township 5 South, Range 11 West , in the Rancho Las Bolsas as shown on a map recorded in Book 51, page 13 of Miscellaneous Maps , records of the County of Orange, all in the City of Huntington Beach, County of Orange, State of California, de- scribed as a whole as follows : Beginning at the intersection of the center lines 1 . of Ellis Avenue and Huntington Street as said center lines are shown on a map of Tract No . 3563, recorded in Book 131, page 8 of Miscellaneous Maps, records of said County of Orange; thence east along said center line of Ellis Avenue 45 . 00 feet to the be- ginning of a tangent curve concave southeasterly and having a radius of 1000. 00 feet; thence westerly and southwesterly along said curve 339 . 26 feet and through a central angle of 19026118" to the be- ginning of a tangent reversing curve concave north- westerly and having a radius of 1000 . 00 feet; thence southwesterly and westerly along said reversing curve 334. 60 feet more or less to a point in the west line of the land described in deed to the Huntington Beach Company, recorded in Book 1134 , page 154 of Official Records of said County; thence north 0002102" east along said west line 114 . 00 feet more or less to a point in said center line of Ellis Avenue; thence east along said center line 614 . 66 feet to the point of beginning. SECTION 2 . The Planning Director of the City of Huntington Beach is hereby directed to change District Map 39 (Sectional District Map 35-5-11) to incorporate the zone change described in Section 1 hereof, and as said district map shall have been amended, the same shall remain in full force and effect and be a part of the Huntington Beach Ordinance Code . A copy of said district map, as amended hereby, is available for inspection in the office of the City Clerk. SECTION 3 . Section 9061, District Map 39 thereof, is hereby amended by Zone Case No. 72-8, effective May, 1972 . SECTION 4 . This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News, a weekly news- paper of general circulation, printed and published in Huntington Beach, California.
