Home My WebLink AboutOrdinance #1805 ORDINANCE NO . 1805 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR CHANGE OF ZONING ON REAL PROPERTY LOCATED APPROXIMATELY 1750 FEET NORTH OF EDINGER AVENUE EAST OF THE PACIFIC RAILROAD RIGHT OF WAY (Zone Case No . 72-37 ) WHEREAS, pursuant to the Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Case No . 72-37 wherein both bodies have carefully considered all in- formation presented at said hearings , and after due consideration of the findings and recommendations of the Planning Commission and all evidence presented to said City Council, the City Council finds that such zone change is proper, NOW, THEREFORE , the City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The following described real property , located approximately 1750 feet north of Edinger Avenue east of the Pacific Railroad right of way, is hereby changed from RA, "Residential Agricultural District to C4 , "Highway Commercial District : " All that certain land situated in the State of California, County of Orange , City of Huntington Beach, described as follows : That portion of the west half of the northwest quarter of the southeast quarter of Section 14 , Township 5 South, Range 11 West , in the Rancho Bolsa Chica, as shown on a map recorded in Book 51, page 13 of Miscellaneous Maps , records of Orange County, California, lying southerly of the following described line : Beginning at a point in the westerly line of said southeast quarter, said point being south 0°16 '03" 1 . west 30 .05 feet from the northwest corner of said southeast quarter, said point also being the point of intersection of a line that is parallel with and distant southerly 30 .00 feet , measured at right angles , from the northerly line of said southeast quarter with said westerly line of the southeast quarter; thence south 89143 ' 57" east at right angles to said westerly line of the southeast quarter 15 .00 feet to a point in a nontangent curve concave south- westerly having a radius of 35 .00 feet, a radial line through said point bears north 16°27 ' 37" west thence southeasterly along said curve through a central angle of 98017140" an arc distance of 60 .04 feet to the beginning of a tangent curve concave northeasterly having a radius of 120 .00 feet; thence southeasterly along said curve through a central angle of 57031124" an arc distance of 120 .48 feet; thence south 65041121" east tangent to said last mentioned curve 581 .07 feet to a point in the easterly line of said west half of the northwest quarter of the southeast quarter of Section 14. Excepting therefrom the southerly 30 .00 feet . Also excepting therefrom that portion included within the right of way of the Southern Pacific Railroad Com- pany . Also excepting and reserving therefrom 50% of a 100% of all minerals , gas , oil, petroleum, naptha, and other hydrocarbon substances in, under or that may be produced or recovered from that portion of said land below a depth of 500 feet from its surface , with and including in such exception and reservation, for the benefit of those entitled thereto, the right at any and all times to enter upon and into any and all parts of the portion of said land below such depth of 500 feet from its surface , for the purpose of exploring and drilling for, mining, developing, removing and extracting any and all such substances , by slant or directional drilling or other operations from other land, entering into and penetrating the land the sub- ject hereof only below such depth of 500 feet from its surface; but with (and there shall be) no right under such exception and reservation of entry upon or use of the surface , or subsurface to a depth of 500 feet below the surface as reserved by Dorothy Thayer Peck, Charles W. Thatcher and Title Insurance and Trust Company, a California corporation, all as trustees of the trust under written declaration thereof by Carrie A. Peck dated December 18, 1936 at 25% of said 100% and by 2 . Dorothy T. Peck, a widow, in her individual capacity as to 25% of said 100% interest . SECTION 2 . The Planning Director of the City of Huntington Beach is hereby directed to change District Map 15 (Sectional District Map 14-5-11) to incorporate the zone change described in Section l hereof, and as said district map shall have been amended, the same shall remain in full force and effect and be a part of the Huntington Beach Ordinance Code . A copy of said district map , as amended hereby, is available for inspection in the office of the City Clerk. SECTION 3. Section 9061, District Map 15 hereof, is amended by Zone Case No . 72-37, effective February , 1973 • SECTION 4 . This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News , a weekly news- paper of general circulation, printed and published in Huntington Beach, California.
