HomeMy WebLinkAboutOrdinance #1811 ORDINANCE NO. 1811 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9513 . 2, SUBSECTIONS (a) AND (b) OF SECTION 9513. 3, SECTION 9518, AND SECTION 9792. 2. AND ADDING THERETO SECTION 9514 . 5, SETTING OUT YARD SETBACK AND LOADING REQUIREMENTS IN RESTRICTED MANUFACTURING DIS- TRICTS, AND PROVIDING FOR LANDSCAPED BUFFER STRIPS AND REQUIREMENTS FOR LANDSCAPING OF OFF-STREET PARKING AREAS The City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The Huntington Beach Ordinance Code is hereby amended by amending Section 9513. 2, subsections (a) and (b ) of Section 9513. 3, Section 9518 and Section 9792. 2 to read as follows : 9513 . 2. FRONT YARD SETBACK. The minimum front yard set- back for parcels that are one (1) ac-re in size or larger, and parcels that are less than one (1) acre in size shall comply with the following requirements : (a) MINIMUM FRONT YARD SETBACK SCHEDULE COLUMN 1 COLUMN 2 Type of (one acre or larger) (less than one acre) j Street (setback in feet) (setback in feet ) Major 40 20 Highway Primary 40 20 Highway Secondary 40 20 Highway Local 20 10 Streets 1. (b) The front yard along major, primary, and secondary highways may be used for parking and access ways , however, a minimum of 25 percent of the required setback under Column 1 and 50 percent of the required setback under Column 2 shall be landscaped. The entire front yard along local streets shall be landscaped. (c ) The front yard shall be landscaped with living plants and permanently maintained. (d) All landscaping shall be provided with an irriga- tion system. (e) Where a building is set back a minimum of twenty (20) feet or less , the entire setback area shall be landscaped. (f) Where parking has been provided within the required setback, a landscaped strip having a minimum width of ten (10) feet shall be provided along the right of way separating the parking lot from the street . (g) One additional foot of setback for each foot of build- ing height above twenty-five ( 25) feet shall be provided. (h) Measurements shall be from the ultimate public right of way line to the nearest front wall of any building. 9513 . 3 (a) Exterior Side Yard Setback. The requirements for exterior side yard setbacks shall be the same as those contained in Section 9513 . 2 . (b) Interior Side Yard Setback. Where an interior side yard abuts property zoned or master planned for residential use, the minimum required side yard shall be forty-five (45) feet , except that the interior side yard setback may be reduced to zero on one side of the lot provided that : (1) Such reduction does not conflict with any other requirement contained herein; ( 2) The wall constructed at the zero setback shall be of maintenance free masonry material, shall be without openings; and ( 3) The opposite side yard is increased to thirty ( 30) feet . Where driveways have been provided to permit access to the rear of a building, the minimum driveway shall be twenty (20) feet . Such driveway shall be maintained free and clear of any obstruction. 2. 9518. TRUCKING AND LOADING REQUIREMENTS . Truck loading, rail loading, and loading well dock facilities , and doors for such facilities shall not face a public street, residential area, or encroach into the required front and exterior side yard set- backs except as follows : (a) Trucking and loading facilities may face a local public street subject to the approval of a use permit application by the Board of Zoning Adjustments . (b ) In reviewing such applications, the Board shall con- sider the following: (1) Said loading facility shall be set back a minimum of forty-five (45) feet from the right of way line . (2) Said loading facility shall not exceed a maximum width of twenty (20) feet . ( 3) Said loading facility shall be located within a fully enclosed structure, screened from view, with doors of a color compatible with the main building. (4) There shall not be an over-concentration of such loading facilities on any one street . The Board of Zoning Adjustments shall attempt to obtain variations in the street scene. (5) Landscaping, displaced by such loading facilities , shall be provided elsewhere . (c) Adequate area shall be provided for the safe operation of trucks in loading areas . (d) Trucking areas shall be adequately paved for the type of operation intended. 9792. 2 . LANDSCAPING. All required landscaping shall be distributed within the off-street parking areas except land- scaping p scaping required by Section 9513 . 3(c) which shall be along the front property line. Additional requirements shall be as fol- lows : (a) Fifteen (15) gallon trees shall be placed throughout the off-street parking lot within the planter areas . Distri- bution of such trees shall be subject to the approval of the Planning Department . (b ) All landscaping within five (5) feet of a public right of way shall be subject to the approval of the Department of 3. Public Works in accordance with the latest landscaping standards . SECTION 2. The Huntington Beach Ordinance Code is hereby amended by adding thereto Section 9514 . 5 to read as follows : 9514 . 5. LANDSCAPED BUFFER. A landscaped buffer of trees shall be provided along that portion of a side and/or rear prop- erty line where such side and/or rear yard abuts property that is zoned or master planned for residential uses or community fa- cilities . Said trees shall be of sufficient size and species to provide maximum screening and buffer from noise and visual in- trusion of an industrial use upon a residential or community fa- cility use. The planter shall be of sufficient size to accom- modate trees and avoid property damage . A landscaping plan de- picting the planter area and species of trees shall be submitted and subject to the approval of the Board of Zoning Adjustments . SECTION 3 . This ordinance shall take effect thirty days after adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News, a weekly news- paper of general circulation, printed and published in Huntington Beach, California.
