HomeMy WebLinkAboutOrdinance #1859 ORDINANCE NO. 1859 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY REPEALING SECTION 9792 .2 .3 , AMENDING SEC- TIONS 9792 . 2 AND 9792 . 2 . 2; AND ADDING SECTION 9730 . 28 PERTAINING TO LANDSCAPING REQUIREMENTS AND REQUIREMENTS FOR COMMERCIAL PARKING LOTS The City Council of the City of Huntington Beach does ordain as follows : SECTION 1. Section 9792 .2 . 3 of the Huntington Beach Ordi- nance Code is hereby repealed. SECTION 2 . The Huntington Beach Ordinance Code is hereby amended by amending Sections 9792 . 2 and 9792 .2 . 2 to read as follows : 9792 . 2 . LANDSCAPING. Landscaping requirements shall be as follows : (a) Fifteen (15) gallon trees shall be placed through the off-street parking lot within the planter areas . Distri- bution of such trees shall be subject to the approval of the Planning Department . (b ) All landscaping within five ( 5) feet of a public right of way shall be subject to the approval of the Department of Public Works in accordance with the latest landscaping stand- ards . (c) A six (6) foot wide (inside dimension) landscaped planter shall be located along the street side property line except for driveway openings . Planting shall be harmonious with the architectural design and site location and shall be maintained at all times in a neat , clean, healthy condition. (d) All required landscaped areas shall be provided with a sprinkler system. 9792 . 2 . 2 . PERCENTAGE OF LANDSCAPING. A minimum of six (6) percent of the site shall be landscaped. Said landscaped areas 1. shall be determined by calculating six (6) percent of the net area of the total site . SECTION 3 . The Huntington Ordinance Code is hereby amended by adding thereto Section 9730 . 28 to read as follows : 9730 . 28 . TEMPORARY COMMERCIAL PARKING LOTS . Temporary parking lots may be permitted for a period of five (5) years subject to approval of use permit application by the Board of Zoning Adjustments . (a) All parking space dimensions , �landscaping, sprinkler systems striping, driveway widths and parking layout shall com- ply with Article 979 . (b ) Paving shall be two (2) inches of asphalt over ninety (90 ) percent compacted native soil or as approved by the Depart- ment of Building and Community Development . (c) On-site signs shall not exceed twelve (12) square feet and shall be in accordance with the design established on the municipal parking lot at the pier, and shall not exceed ten (10) feet in height . (d) Physical protection from vehicle and pedestrian damage to landscaping shall be provided by one of the follow- ing methods : (1) Wheel bumpers (2) Concrete curbs ( 3) Any other design that will provide protection and is acceptable to the Board of Zoning Adjustments at the time of approval. (e) Parking lots that are designed to have automatically controlled entry devices shall have these devices set back twenty ( 20 ) feet from the property line at such entrance or .at a distance stipulated by the Board of Zoning Adjustments . (f) The Board of Zoning Adjustments approval action on the application shall be subject to periodic review for compliance with the initial conditions of approval . The Board of Zoning Ad- justments shall initiate permit revocation proceeding when the conditions of approval of the use permit have not been complied with. (1) Failure or refusal of the property owner to clean up the site or maintain the site in a clean con- dition and free of trash or debris . (2) A condition which may tend to depreciate the 2 . value of the surrounding properties . (3) The Board of Zoning Adjustments may order the immediate cessation of the temporary use if all conditions, requirements and provisions of Division 9 have not been met SECTION 4 . The provisions of this ordinance insofar as they are substantially the same as existing provisions of the Huntington Beach Ordinance Code relating to the same subject matter shall be construed as restatements and continuations and not as new enactments . SECTION 5. This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News, a weekly news- paper of general circulation, printed and published in Huntington Beach, California.
