HomeMy WebLinkAboutOrdinance #1894 ORDINANCE NO. 1894 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY REPEALING SECTION 2525 AND ARTICLES 253, 2542 255 AND 256 OF CHAPTER 25, AND AMENDING SECTIONS 2511 AND 2523 PERTAINING TO ISSUANCE OF PERMITS FOR MOTION PICTURE EXHIBITIONS The City Council of the City of Huntington Beach does ordain as follows : SECTION 1. Section 2525 and Articles 253, 254, 255 and 256 of Chapter 25 of the Huntington Beach Ordinance Code are hereby repealed. SECTION 2. The Huntington Beach Ordinance Code is here- by amended by amending Sections 2511 and 2523 to read as fol- lows : 2511. EXEMPTIONS. NONCOMMERCIAL EXHIBITIONS. The per- mit provisions of this chapter shall not apply to any motion picture exhibition room or auditorium in any school building or premises of any religious organization in this city which exhibition is being conducted under authority and direction of such school or religious organization. 2523 . BUILDING PREREQUISITES. No permit to hold, con- duct or carry on a motion picture exhibition, or any enter- tainment at which motion pictures are exhibited shall be granted by the Council unless the building or room in which said exhibition or entertainment is to be held or carried on, shall conform to all of the provisions of the Uniform Building Code and the Uniform Fire Code, and any future amendments or additions appertaining thereto. SECTION 3. The provisions of this ordinance insofar as they are substantially the same as existing provisions of the Huntington Beach Ordinance Code relating to the same subject matter shall be construed as restatements and continuations and not as new enactments . 1. The City Clerk shall certify to the pas- sage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News, a weekly newspaper of general circulation, printed and published in Huntington Beach, California. Vvs-►Y 1 vvU ----------------- City Clerk uty �ii; k ORDINANCE NO. 1895 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING DISTRICT MAP 40 TO INCLUDE PRECISE PLAN NO. 72-7 WHEREAS, pursuant to the Planning and Zoning Law, par- ticularly Government Code Sections 65351 et seq. , the Plan- ning Commission of the City of Huntington Beach, after notice duly given, held a public hearing on September 19, 1972 to amend street alignments for Hoyt Lane, Lister Lane and Constantine Drive, located approximately 600 feet east of Beach Boulevard, between Ellis Avenue and Garfield Avenue; and On October 16, 1972, after notice duly given, hearing was held before this Council, and the matter having been con- sidered, the Council finds -that said Precise Plan No . 72-7 is reasonably necessary to the orderly and efficient flow of traffic, for the preservation of the health and safety of the inhabitants of the city, and for the orderly development of the community, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows : SECTION 1. That the real property hereinafter described and shown on the map marked Exhibit "A" attached hereto, in- corporated herein and by reference made a part hereof, is hereby designated and adopted as Precise Plan No. 72-7 of the City of Huntington Beach. SECTION 2. District Map 40 (Sectional District Map 36-5-11) is hereby amended to include Precise Plan No . 72-7, to amend street alignments for Hoyt Lane, Lister Lane and Constantine Drive. 1 . The precise plan, as shown on the map marked Exhibit "A, " amending Sectional District Map 36-5-115 is here- inafter more particularly described and shall be as follows: Those portions of the southwest quarter (SWl/4) of Section 5 South, Range 11 west in the Rancho Las Bolsas, City of Huntington Beach, County of Orange, State of California, as shown on a map recorded in Book 51, page 13 of Miscellaneous Maps in the office of the County Recorder of said county, described as follows : HOYT LANE: Beginning at the northwest corner of Tract 8011 as shown on a map recorded in Book 330, page 5 of Miscellaneous Maps in the office of the County Recorder of said county, said corner lies on the northerly line of Hoyt Lane being a curve concave to the south having a radius of 46. 00 feet, a radial line to said point bears north 0047 ' 57" west; thence southwesterly, southerly and southeasterly along said curve through a central angle of 126°52112" an arc distance of 101 . 86 feet to a reverse curve concave to the southwest having a radius of 54. 00 feet; thence southeasterly along said curve to its inter- section with the west line of Hoyt Lane, as de- scribed in a deed to the City of Huntington Beach, recorded November 3, 1965 in Book 48 of Official Records in the office of the County Recorder of said county; thence northerly along said west line and northerly and northeasterly along the west line of Hoyt Lane, as described in a deed to the City of Huntington Beach, recorded November 3 , 1965 in Book 7728, page 52 of Official Records in the office of the County Recorder of said county, to the north line of the right of way for Hoyt Lane, as described in the last mentioned deed; thence easterly along said line to the west line of said Tract No . 8011; thence north 0047 ' S7" west 8 .18 feet along said west line to the true point of beginning.
