Home My WebLink AboutOrdinance #1923 ORDINANCE NO. 1923 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR CHANGE OF ZONING ON REAL PROPERTY LOCATED AT THE NORTHEAST CORNER OF MEMPHIS AVENUE AND DELAWARE STREET (ZONE CASE NO. 73-26) WHEREAS, pursuant to the state Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Case No. 73-26 wherein both bodies have carefully considered all information presented at said hearings, and after due con- sideration of the findings and recommendations of the Planning Commission and all evidence presented to said City Council, the City Council finds that such zone change is proper, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows : SECTION 1 . The following described real property, located at the northeast corner of Memphis Avenue and Delaware Street, is hereby changed from R5, "Office-Professional District" and R5-0 , "Office-Professional District" combined with oil pro- duction, to R2-PD-10, "Medium Density Residential Planned Develop- ment District," permitting a maximum density of ten (10) units per acre: The North half of the South half of the Southwest quarter of the Northeast quarter of the Northeast quarter of Section 11, Township 6 South, Range 11 West, in the Rancho Las Bolsas, City of Huntington Beach, County of Orange, State of California, as per map recorded in Book 51, page 14 of Miscellaneous Maps , in the office of the County Recorder of said County . EXCEPTING THEREFROM an undivided 1/2 interest in and to all oil, gas , minerals, and other hydro- carbon substances lying below a depth of 500 feet 1 . /k 6/14/74 measured vertically from the real property herein- above described without however, the right to use the surface of said real property for the exploration or development of said substances , as conveyed to Charles E. Cather and William Cree, Jr. , doing business as Cather & Cree Oil Co. by deed recorded October 3, 1973 in book 10927, page 977, Official Records . The North one-half of the Southwest quarter of the Northeast quarter of the Northeast quarter of Section 11, Township 6 South, Range 11 West, S .B.B. &M. , City of Huntington Ba. EXCEPTING THEREFROM an undivided 1/2 interest in and to all oil, gas , minerals and other hydrocarbon substances lying below a depth of 500 feet measured vertically from the real property hereinabove described, without however, the right to use the surface of said real property for the exploration or develop- ment of said substances as conveyed to Charles E. Cather and William H. Cree, Jr. , doing business as Cather & Cree Oil Co. by deed recorded October 3, 1973 in book 10927, page 975, Official Records . The South half of the South half of the Southwest quarter of the Northeast quarter of the Northeast quarter of Section 11, in Township 6 South, Range 11 West, San Bernardino Base and Meridian, in the City of Huntington Beach. EXCEPTING THEREFROM an undivided 1/2 interest in and to all oil, gas , minerals and other hydrocarbon substances lying below a depth of 500 feet measured vertically from the real property hereinabove described, without however, the right to use the surface of said real property for the exploration or development of said substances as conveyed to Charles E. SECTION 2. The Planning Director of the City of Huntington Beach is hereby directed to change District Map 12 (Sectional District Map 11-6-11) to incorporate the zone change described in Section 1 hereof, and as said district map shall have been amended, the same shall be in full force and effect and be a part of the Huntington Beach Ordinance Code . A copy of said district map, as amended hereby, is available for inspection in the office of the City Clerk. SECTION 3. Section 9061, District Map 12 thereof, is hereby amended by Zone Case No . 73-26 effective September, 1974 . SECTION 4 . This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News , a weekly news- paper of general circulation, printed and published in Huntington Beach, California.
