AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY AMENDING CERTAIN SECTIONS AND ADDING
SECTION 9232 .6 .2 ALL PERTAINING TO BUILDING
HEIGHT LIMITS
The City Council of the City of Huntington Beach does
ordain as follows :
SECTION 1. The Huntington Beach Ordinance Code is hereby
amended by amending Sections 9102 .6 , 9102. 6 .1, 9102. 6 . 1. 1,
9102 . 6 .1 . 3, 9103. 2 . 1, 9154 .5, 9155 .2, 9162. 6, 9162. 6.1,
9162 .6 . 1. 1, 9163. 2. 1, 9202 . 6, 9202 .6 .1 .1, 9203. 2 . 1, 9232 .6 ,
9232 . 6 . 1, 9233 . 2 .1, 9242 .4, 9320 .5, 9320 . 7, 94o4 .1, 9413 . 3,
9473, 9602. 6, 9621. 2(c ) , 9621.2(e) , 9697(c ) , and 9700 . 2(3) to
read as follows :
9102 . 6 . MAXIMUM BUILDING HEIGHT. The maximum
building height shall not exceed thirty (30) feet , except as
provided herein.
9102 .6 .1 . EXCEPTION. BUILDING HEIGHT. A maximum
building height of thirty-five (35 ) feet , may be permitted
pursuant to the provisions contained herein.
9102 . 6 . 1.1 . BUILDINGS OVER THIRTY FEET. SETBACK REQUIRE-
MENT. The exterior wall of any building exceeding thirty (30)
feet in height shall be set back one hundred (100) feet or
more from any existing single-family residential building,
except where the building site is separated from such single-
family residential dwelling by a public right-of-way, school
site , golf course , public utility right-of-way, flood control
right-of-way or channel, which is sixty (60 ) feet or more in
clear width.
9102 . 6 .1 . 3. USE PERMIT REQUIRED. A use permit is
required for all proposed buildings exceeding thirty ( 30 ) feet
in height . The following criteria shall serve as guidelines
for the Board in approving, conditionally approving or denying
such use permit applications:
,(a) The proposed building shall not have a detrimental
effect upon the general health, welfare, safety and privacy of

persons residing in the neighborhood, or the value of properties
in such neighborhoods .
(b) The location, site layout and design of the building
shall be harmonious and compatible with the streets , driveways,
property lines , and adjacent dwellings of the neighborhood.
(c ) The age and anticipated permanence of existing buildings
on adjacent properties .
9103. 2 .1. INTERIOR SIDE YARD. SETBACK REQUIREMENT.
(a) The minimum interior side yard setback for buildings
thirty ( 30) feet or less in height shall be ten percent (10%) of
the lot width. Provided further that said side yard setback need
not exceed five (5) feet, and shall not be less than three (3)
feet .
(b ) The minimum interior side yard setback for buildings
exceeding thirty ( 30 ) feet in height shall not be less than ten
(10 ) feet .
9154 .5 . MAXIMUM BUILDING HEIGHT. The maximum
building height shall not exceed thirty (30) feet .
9155 .2 . INTERIOR SIDE YARD. SETBACK REQUIREMENT.
The minimum interior side yard setback shall be ten (10) percent
of the lot width for buildings fifteen (15) feet or less in
height and twenty ( 20 ) percent for buildings over fifteen (15)
feet in height. Said side yard setback need not exceed ten (10 )
feet and shall not be less than five (5 ) feet .
9162. 6 . MAXIMUM BUILDING HEIGHT. The maximum building
height shall not exceed thirty (30) feet, except as provided
herein.
9162 .6 . 1 . EXCEPTION. BUILDING HEIGHT. A maximum
building height of thirty-five (35) feet may be permitted
pursuant to the provisions contained herein.
9162 . 6 . 1.1. PROPOSED BUILDINGS OVER THIRTY FEET. SET-
BACK REQUIREMENT. The exterior wall of any proposed building
exceeding thirty (30) feet in height shall be set back one
hundred (100) feet or more from the property line of any single-
family residential development except that such setback may be
eighty-five (85 ) feet where such building site is to be separated
from such single-family residential development by parking
structures, such as carports or garages, constructed on a common

of-way, flood control right-of-way or channel, which is sixty
(60) feet or more in clear width.

the lot width. Said side yard setback need not exceed five (5 )
feet , and shall not be less than three (3) feet .
(b ) The minimum interior side yard setback for buildings
exceeding thirty (30) feet in height shall not be less than ten
(10 ) feet .
9242.4 . MOBILEHOMES, RECREATION BUILDINGS, OTHER
STRUCTURES. MAXIMUM BUILDING HEIGHT.
(a) The maximum building height for mobilehomes shall not
exceed twenty (20 ) feet except that mobilehomes that do not
exceed a height of thirty ( 30) feet may be permitted upon approval
of a use permit application by the Board of Zoning Adjustments .
(b) The maximum building height for all structures other
than recreation buildings and mobilehomes shall not exceed
fifteen (15 ) feet .
(c ) The maximum building height for recreation buildings shall
not exceed thirty-five (35) feet .
9320 . 5 . MAXIMUM BUILDING HEIGHT. The maximum building
height shall not exceed thirty-five (35) feet .
9320 . 7 . SETBACK FROM INTERIOR PROPERTY LINE. The
setback from interior property lines shall be as follows :
(a) Carports or garages may be constructed along the property
line subject to approval by the Board of Zoning Adjustments .

However, where a setback is provided, such setback shall be a
minimum of ten (10 ) feet .
(b) The minimum setback for buildings thirty (30 ) feet or
less in height shall not be less than ten (10 ) feet . One foot of
additional setback shall be provided for each two and one-half (2
1/2) feet of building length parallel with the property line of
any single-family residential development for buildings over
twenty-five (25) feet in length.
(c ) The minimum setback for buildings exceeding thirty (30)
feet in height shall not be less than ten (10) feet except as
follows :
(1) Such building shall be set back not less than one
hundred (100) feet from the property line of any single-family
residential development .
(2) Such building may be set back not less than
eighty-five ( 85) feet from the property line of any single-
family residential development when it is separated from said
property line by parking structures such as carports or garages .
9404 .1. MAXIMUM BUILDING HEIGHT. The maximum building
height shall not exceed thirty-five (35) feet .
EXCEPTION: Rooftop mechanical equipment and screening may
exceed the thirty-five (35) foot height limit, provided that
they shall not exceed building height by more than fourteen (14 )
feet . Screening shall set back fifteen (15) feet from any
exterior building edge and shall not project above the equip-
ment which it is -designed to screen.
9413. 3. MAXIMUM BUILDING HEIGHT. The maximum building
height shall not exceed twenty (20 ) feet .
9473. MAXIMUM BUILDING HEIGHT. ALL USES. The
maximum building height shall not exceed thirty-five (35) feet .
9602 . 6 . MAXIMUM BUILDING HEIGHT. The maximum building
height shall not exceed thirty (30) feet .
9621. 2 . (c ) (2) No such building or structure shall exceed
thirty ( 30) feet in height .
9621.2 . (e) (2) No such building or structure shall exceed
fifteen (15 ) feet in height.

9697. (c ) Maximum building height shall be forty-five ( 45)
feet except that any structure located within fifty (50) feet of
property that is used, master planned, or zoned for residential
use shall not exceed fifteen ( 15) feet in height .
9700 . 2 . ( 3) BUILDING HEIGHT. The vertical distance from
the lowest elevation of the ground level immediately adjacent to
the building, to the highest point of the roof.
SECTION 2 . The Huntington Beach Ordinance Code is hereby
amended by adding Section 9232 .6 .2 to read as follows :
9232 .6 .2 . EXCEPTION. BUILDING HEIGHT. A maximum
building height of thirty-five ( 35) feet may be permitted
pursuant to the provisions contained herein.
SECTION 3 . This ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the passage
of this ordinance and cause same to be published within fifteen
days after adoption in the Huntington Beach News , a weekly news-
paper of general circulation, printed and published in Huntington
Beach, California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 6th
day of January, 1975 .
