AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY AMENDING CERTAIN SECTIONS PERTAINING TO
REAR YARD SETBACKS IN THE Rl DISTRICT
The City Council of the City of Huntington Beach does
ordain as follows :
SECTION 1. The Huntington Beach Ordinance Code is hereby
amended by amending Sections 9102 . 4, 9103. 3, 9103. 3 . 1 . 2,
9103. 3.3 and 9103. 4 . 2. 3 to read as follows :
9102 . 4 . LOT COVERAGE . The ground floor area of all
roofed structures on lots not abutting a park, recreation area,
public waterway, or open land shall not occupy more than 50
percent of the lot area. The ground floor area of all roofed
structures on lots abutting a park, recreation area, public
waterway, or open land shall not occupy more than 55 percent
of the lot area.
For the purpose of this section, open land includes golf
courses , school sites , public utility rights-of-way, and flood
control rights-of-way that provide a minimum of 100 feet in
clear width.
9103. 3 . REAR YARD. The minimum rear yard shall be
ten (10 ) feet . However, such rear yard may be reduced to five
(5 ) feet on any lot abutting open land, as defined in Section
9102 . 4 .
9103. 3. 1. 2 . WATERFRONT LOTS. Waterfront lots with forty
(40 ) feet or more of water frontage, shall not be subject to the
open space requirement, of this article .
9103. 3. 3• PATIO COVERS IN THE REAR YARD. Except as
provided herein patio covers may be constructed to within five
(5 ) feet of the rear property line .
9103. 4 .2 . 3. OPEN UNENCLOSED STAIRWAYS OR BALCONIES . Open
unenclosed stairways or balconies , not covered by a roof or
canopy, may extend four (4) feet into the required front yard and
may extend into the required side yard to within three (3) feet
of the property line . However, such stairways or balconies shall

maintain ,a minimum distance of five (5) feet from any portion of
any other building on the same lot . Structures on lots abutting
a public waterway may have balconies projecting into the required
rear yard setback, not to exceed five (5) feet .
SECTION 2 . This ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the passage
of this ordinance and cause same to be published within fifteen
days after adoption in the Huntington Beach News, a weekly
newspaper of general circulation, printed and published in
Huntington Beach, California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 6th
day of January, 1975 .

that the foregoing ordinance was read to said City Council at a regular
meeting thereof held on the 16th day of December
19 74 , and was again read to said City Council at a regular
meeting thereof held on the 6th day of January , 19 75 and
was passed and adopted by the affirmative vote of more than a majority of
all the members of said City Council.
