HomeMy WebLinkAboutOrdinance #1980 ORDINANCE NO. 1980 AN EMERGENCY ORDINANCE OF THE CITY OF HUNTINGTON BEACH SUSPENDING THE OPERATION OF ARTICLE 311 OF CHAPTER 31 OF THE HUNTINGTON BEACH ORDINANCE CODE PERTAINING TO THE COLLECTION OF REFUSE WHEREAS, refuse collection for residents and commercial and industrial users within the city of Huntington Beach is being interrupted and curtailed by the strike of the employees of Rainbow Disposal Company; and The excessive accumulation of refuse in homes and com- mercial establishments is a hazard to public health and safety; and The enforcement of certain provisions of the existing sanitation ordinance is temporarily impracticable, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows : SECTION 1 . The City Administrator may in his discretion and for the duration of the current emergency, suspend the operation of any or all sections of Article 311 of Chapter 31 of the Huntington Beach Ordinance Code, excepting the require- ments of Section 3111. 14 . 9 thereof. SECTION 2 . The City Administrator is authorized to issue temporary certificates of need and necessity to responsible refuse collectors which certificates shall be valid only for the duration of the present emergency, provided, however, that compliance with provisions of Section 3111 . 14 . 9 shall be a con- dition precedent to the issuance of any such certificate . SECTION 3 . The City Council shall by resolution declare that the emergency has ended. g y SECTION 4 . This ordinance is an emergency measure for the immediate preservation of the public health and safety, which WSA: ahb 1. emergency is set forth and defined in the preamble hereof, and shall take effect and be in force from and after the passage and adoption of this ordinance. SECTION 5 . The City Clerk shall certify to the passage of this ordinance and cause same to published by one insertion in the Huntington Beach News , a weekly newspaper printed, published and circulated in the city of Huntington Beach, California.
