ORDINANCE NO. 1984
AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY REPEALING SECTIONS 9481. 16 AND 9482. 3 THROUGH
9482 .10; BY AMENDING CERTAIN SECTIONS OF ARTICLE
948 ; AND ADDING THERETO SECTIONS 9481.17 . 3 AND
9481.17. 4, ALL PERTAINING TO SERVICE STATION
STANDARDS
The City Council of the City of Huntington Beach does
ordain as follows :
SECTION 1. The Huntington Beach Ordinance Code is hereby
amended by repealing Sections 9481.16 and 9482. 3 through
9482. 10 .
SECTION 2. The Huntington Beach Ordinance Code is hereby
amended by amending Sections 1411.8, 9481.9, 9481.17 , 9481. 17 . 1,
9481. 17. 2, 9482 and 9482. 1 to read as follows :
9481. 8 . LANDSCAPING. A minimum of ten (10) percent of
the total site shall be landscaped and permanently irrigated
in the following prescribed areas :
(a) Six (6) foot wide (inside dimension) planters shall
be located along the street side property lines except for
driveway openings .
(b) A three (3) foot wide (inside dimension) planter
shall be located along the interior property line except for
openings to facilitate vehicular circulation to adjacent proper-
ty . Fifteen (15) gallon trees shall be located along the
interior property line planter at a forty-five (45) foot
average on center.
Additional trees or landscaping shall be required to screen
service bays from adjacent commercial or residential property .
(c ) A planting area composed of not less than six hundred
(600 ) square feet with a minimum dimension of twenty (20 ) feet
shall be located at the corner of two (2) intersecting streets .

(d) Seventy (70 ) square feet of planting area shall be
located along those portions of the main building facing a
public street .
(e) All planting areas shall be separated from adjacent
paved surfaces by a six (6) inch wide and six (6) inch high
concrete curb .
Planting shall be harmonious with the architectural
design and site location and shall be maintained at all times
in a neat , clean, healthy condition, and shall comply with
landscaping standards in effect at the time of application
for an administrative review. Plantings shall not exceed a
height of three (3) feet, except trees and plantings located
next to the main structures and along the interior property
line, shall exceed three and one-half (3 1/2) feet.
9481. 9 . TRASH STORAGE AREAS. Areas for storage
of trash, refuse, and discarded automobile parts shall be
provided on site behind the required setback. Such trash
area shall be screened by a six (6) foot high enclosure
equipped with a gate . All such enclosures shall be con-
structed of material and in a manner which blends with the
architecture and aesthetics of the main structure .
9481. 17 . SIGNS. All signs shall conform to the
provisions contained in the following sections and to portions
of Article 976 which relate to service stations .
9481 .17. 1. MAJOR IDENTIFICATION SIGNS. One (1)
major identification sign shall be allowed. Such identifi-
cation sign shall be located in a landscaped area and shall
not exceed a height of ten (10) feet . Such sign shall
contain only the name or symbol of the business which it
identifies and shall not contain change panels . The hori-
zontal dimension of such sign shall not exceed eight feet
six inches ( 81611 ) . Such sign shall not exceed forty (40)
square feet per face .
9481. 17 . 2 . MISCELLANEOUS .SIGNS. Miscellaneous signs
for the purpose of providing information, such as price,
credit, public services and similar identification, shall
comply with the following standards:
(a) Detached Signs . One (1) detached miscellaneous
sign is allowed for each street the service station abuts ,
subject to the following:
(1) Except as hereinafter provided, such sign shall
not exceed seven (7) feet in height from ground level,
nor five (5) feet in width.
(2) Each sign may be double-faced and internally
or indirectly lighted.

(3) Each sign shall be placed in such manner as
to minimize interference with traffic .
(4) Each permitted miscellaneous sign shall be
erected in a landscaped planter.
(b ) Required Signs . Signs required by a governmental
agency, including but not limited to, "No Smoking, " "Licensed
Inspections and Adjustments ," and similar identification, may
be placed on the main building, or as follows :
(1) One additional detached sign incorporating such
information may be in a landscaped planter.
(2) Such sign information may be incorporated into
the detached sign permitted under Section 9481. 17. 2(a) . The
area required by such sign may be in addition to that permitted
by Section 9481. 17 . 2(a) .
9482. NONCONFORMING SERVICE STATION SITES. Existing
service station sites made nonconforming as a result of this
article shall be made to comply with the requirements of this
article according to the following schedule . Where standards
contained herein are inconsistent with other requirements of
this article , the standards contained herein shall govern.
(a) Restroom screening, trash storage area, tire storage,
and miscellaneous signs shall be removed or altered to comply
with the provisions of this article not later than October 1,
1975 .
(b) Not later than October 1, 1975, a minimum of six (6)
percent of the total site area shall be landscaped and thereafter
well maintained and provided with an approved sprinkler system.
Portions of the required landscaping shall be allocated as
follows :
(1) Where the exterior drive apron of a pump island
is sixteen (16) feet in width or greater, a landscaped planter
having a width of not less than three ( 3) feet (inside dimension)
shall be provided along the street side property lines between
driveway openings .
(2) A landscaped planter shall be provided at the
corner of two intersecting streets .
(3) Notwithstanding (1) and (2) above, where place-
ment of plants would impede vehicular access or on-site circula-
tion, landscaping may be placed elsewhere on the property to
attain the minimum requirements .
(4 ) Landscaping shall be placed in a manner to
effectively buffer the site from the public right-of-way and
adjacent properties .

(5) Not less than five (5) fifteen (15) gallon
trees shall be provided within landscaped planters .
(6) Specific placement of materials within planter
areas, specie, number, and size shall comply with plans and
specifications on file with the Department of Public Works of
the city of Huntington Beach.
(c ) The Board of Zoning Adjustments , upon written applica-
tion, may grant a reduction in the landscaping requirements
providing that any of the following conditions exist:
(1) The reduction is necessary for traffic safety.
(2) Reduction of landscaping would not substantially
reduce the buffering effect from the right-of-way or interior
properties .
( 3) The design of the service station site is unique
and landscaping in compliance with this article cannot be achieved
and attain an aesthetic appearance .
(d) Major identification signs shall comply with the pro-
visions of this article not later than July 1, 1978.
(e) Plans to make existing nonconforming service station
sites conforming to this article shall be submitted to the
Building and Community Development Department for review and
approval in accordance with the provisions of Section 9482 prior
to commencement of improvements .
(f) The Building and Community Development Director shall
not approve any proposed alterations to a service station site
pursuant to this article until all of the following conditions
have been met:
(1) Such alterations meet the applicable provisions
of the Huntington Beach Ordinance Code.
(2) All signs proposed are directly related to identi-
fying the business , services rendered, operating instructions , and
primary products , and do not advertise secondary products, such as
oil, tires or other merchandise.
(3) Proposed landscaping is placed in a manner which
effectively buffers the operation of the service station from
adjacent property and the public right-of-way.
The Director of Building and Community Development shall deny
any such proposal if any of the following conditions exist :
(i) Proposed alterations will have a detrimental
effect on the general health, welfare, and safety of persons
residing or working in the neighborhood, or are detrimental to
the value of property and improvements in the neighborhood.

(ii ) The proposed alterations are not compatible
with existing or permitted uses in the neighborhood.
(iii) The location, layout and design of the
proposed alterations do not properly adapt to existing streets ,
driveways , and other adjacent structures and uses in a harmonious
manner.
9482 . 1. MODERNIZATION OF NONCONFORMING USES. All pro-
posals to modernize existing service stations shall be subject
to approval by the Building and Community Development Director.
All existing service station sites are exempt from the locational
criteria and minimum building site area and dimensional require-
ments of this article .
(a) When proposed modernization of existing service station
site improvements within any twelve (12 ) month period is twenty-five
(25) percent or more of the value of said service station site
improvements , the entire service station site shall be made to
conform to all requirements contained in Section 9482 at the time
of modernization, provided further that signs under Section
9482(d) shall comply immediately.
(b ) When proposed modernization of existing service station
site improvements within any twelve (12 ) month is less than
twenty-five (25) percent of the value of the service station site
improvements , such alterations shall conform to the requirements
contained in subsections (a) and (b ) of Section 9482 at the
time of modernization.
SECTION 3. The Huntington Beach Ordinance Code is hereby
amended by adding Sections 9481. 17. 3 and 9481. 17. 4 to read
as follows :
9481.17. 3. PUMP ISLAND SIGNS . Signs designating
operating instructions , self-serve and full serve islands ,
or similar information designed for customer convenience, may
be affixed to each pump island canopy support column, or in
the alternative may be placed on the fuel pump . Such signs may
be double-faced but shall not exceed two (2) square feet in area.
9481 .17. 4 . TRADEMARKS . Trademarks , abbreviations,
slogans , symbols and logos which identify the service station
may be placed on the main building and pump islands . Such
identification signs may be double-faced. There shall be
not more than two (2) such identification signs per building
nor more than one (1) per pump island.
SECTION 4 . This ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the passage
of this ordinance and cause same to be published within fifteen

days after adoption in the Huntington Beach News , a weekly news-
paper of general circulation, printed and published in Huntington
Beach, California.
PASSED AND ADOPTED by the City Council of the city of
Huntington Beach at a regular meeting thereof held on the 7th
day of July, 1975 .
