AN EMERGENCY ORDINANCE OF THE CITY OF HUNTINGTON
BEACH EXTENDING MORATORIUM ON THE ISSUANCE OF
BUILDING PERMITS BY THE DEPARTMENT OF BUILDING
AND COMMUNITY DEVELOPMENT WITH RESPECT TO CER-
TAIN REAL PROPERTY WITHIN THE SUNSET HEIGHTS DIS-
TRICT OF HUNTINGTON BEACH
WHEREAS, the City Council of the City of Huntington Beach
desires to extend for a period of one (1) year a moratorium on
all new construction in a designated area of the city to enable
the Planning Department and Planning Commission to study said
area further for contemplated zoning proposals and uses ; and
Notice having been given pursuant to Section 65856 of
the California Government Code and public hearing having been
held; and
The Planning Department and the Planning Commission of
the city are hereby instructed to study said designated area
for contemplated zoning proposals and uses ; and
The City Council of the City of Huntington Beach finds it
necessary that this ordinance be adopted as an emergency measure
to protect the public health, safety and welfare by adopting an
interim ordinance on the property described in Exhibit "A" and
shown on District Map 23, attached hereto and by reference
made a part hereof; and
Huntington Beach Ordinance Code Section 9051 and California
Government Code Section 65858 permit the extension of an interim
ordinance as an emergency measure to protect the public health,
safety and welfare,
NOW, THEREFORE, pursuant to the provisions of Huntington
Beach Ordinance Code Section 9051 and Section 65858 of the
California Government Code, in order to protect the public
health, safety and welfare, the City Council of the City of
Huntington Beach does ordain as follows :

SECTION 1. The real property described in Exhibit "A"
and shown on District Map 23 attached hereto and by ref-
erence made a part hereof, is hereby declared to be located
within an interim zone and any new construction or the issuance
of new building permits on said property is prohibited except
as hereinafter provided. The following are excepted from the
provisions of this emergency ordinance:
(a) Permits necessary for repair and maintenance of
existing structures ; or
(b) Permits necessary for completion of construction for
which a valid building permit has been issued; or
(c ) Permits necessary to alter or remodel any structure
provided the dwelling unit density will not be increased
thereby; or
(d) Building permits issued prior to the effective date
of this ordinance .
SECTION 2. The real property to be located within the
interim zone is the area located in the city of Huntington Beach,
County of Orange, State of California as described in Exhibit "A"
and as shown on District Map 23, attached hereto and by
reference made a part hereof.
SECTION 3 . This is an emergency ordinance necessary for
the immediate preservation of the public health, safety and
welfare, and shall take effect upon adoption. This ordinance
shall be of no further force and effect after one (1) year from
its adoption. The City Clerk shall certify to the passage of
this ordinance and shall cause same to be published within fif-
teen days of its passage in the Huntington Beach News , a news-
paper of general circulation, printed and published in Huntington
Beach, California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at an adjourned regular meeting thereof held
on the 8th day of September, 1975.
