Home My WebLink AboutOrdinance #2011 ORDINANCE NO. 2011 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR CHANGE OF ZONING ON REAL PROPERTY LOCATED NORTH OF YORKTOWN AVENUE AND WEST OF MAGNOLIA STREET (ZONE Case no . 75-05) WHEREAS, pursuant to the state Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Change No. 75-05 wherein both bodies have carefully considered all information presented at said hearings, and after due con- sideration of the findings and recommendations of the Planning Commission and all evidence presented to said City Council, the City Council finds that such zone change is proper, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The following described real property located north of Yorktown Avenue and west of Magnolia Street is hereby changed from CF-E, "Community Facility-Educational District" to R13 "Low Density Residential District : " All that certain land situated in the State of California, County of Orange, described as follows : PARCEL 1: The Easterly 364. 00 feet of the Southwest quarter of the Northeast quarter of Section 1, Township 6 South, Range 11 West, in the Rancho Las Bolsas, City of Huntington Beach, County of Orange, State of California, as said Section is shown on a map recorded in book 51 page 14 of Miscellaneous Maps , in the office of the County Recorder of said County. Except one-half of all oil, gas and other hydrocar- bon or mineral substances , in, under or that may be produced from said land, with all rights incident thereto other than and not including any right of entry upon or use of the surface, or of the sub- surface above a depth of 500 feet below the surface of any part of said land, as reserved by Dorothy T. er7 1. Peck, Charles H. Thatcher, as executors of the will of Aldrich R. Peck, deceased, as to an undi- vided 25% of the entire 100% interest, and by ,Dorothy Thayer Peck, Charles H. Thatcher, and Title Insurance and Trust Company, a California corporation, as trustees of the trust under written declara- tion thereof, by Carrie A. Peck, dated December 18, 1936 as to a like undivided 25% of the entire 100% interest, in deed recorded February 9 , 1959, in book 4578 page 306 of Official Records. ALSO EXCEPT the remainder of all oil, gas and other hydrocarbon or mineral substances, in, under or that may be produced from said land, with all rights incident thereto other than and not including any right of entry upon or use of the surface, or of the sub-surface above a depth of 500 feet below the surface of any part of said land, as reserved by Roy K. Sakioka and Tomio Sakioka, husband and wife, in deed recorded July 26, 1966 in book 7998 page 994, Official Records. PARCEL 2: The Southeast quarter of the Northeast quarter of Section 1, Township 6 South, Range 11 West, in the Rancho Las Bolsas, in the city of Huntington Beach, County of Orange, State of California, as per map recorded in book 51 page 14 of Miscellaneous Maps, in the office of the County Recorder of said County. EXCEPT therefrom an undivided 3/4ths interest in all oil, gas and other hydrocarbon substances and minerals now or hereafter in, on and under said land, as granTed to Henry A. Holtz, Joseph Leo Holtz, Jr. ,. and Andrew Leo Holtz by deed recorded October 25, 1946 in book 1503 page 14 of Official Records. SECTION 2. The Planning Director of the City of Huntington Beach is hereby directed to change District Map 1 (Sectional District Map 1-6-11) to incorporate the zone change described in Section 1 hereof, and as said district map shall have been amended, the same shall be in full force and effect and be a part of the Huntington Beach Ordinance Code. A copy of said district map, as amended hereby, is available for inspection in the office of the City Clerk. SECTION 3. Section 9061, District Map 1 thereof, is hereby amended by Zone Case No. 75-05. SECTION 4. This ordinance shall take effect thirty days after its adoption. The Cit y Clerk shall certify tQ the pas- 2. sage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News , a weekly newspaper of general circulation, printed and published in Huntington Beach, California.
