HomeMy WebLinkAboutOrdinance #2012 ORDINANCE NO. 2012 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR CHANGE OF ZONING ON REAL PROPERTY LOCATED 352 FEET WEST OF BROOKHURST STREET AND APPROX IMATELY 690 FEET NORTH OF BANNING AVENUE (ZONE CASE NO. 75-06) WHEREAS, pursuant to the state Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Change No. 75-06 wherein both bodies have carefully considered all information presented at said hearings, and after due con- sideration of the findings and recommendations of the Planning Commission and all evidence presented to said City Council, the City Council finds that such zone change is proper, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows: SECTION 1. The following described real property located 352 feet west of Brookhurst Street and approximately 690 feet north of Banning Avenue is hereby changed from CF-E, "Community Facility-Educational District" to Rl, "Low Density Residential District : " All that certain land situated in the State of California, County of Orange, City of Huntington Beach, described as follows : A portion of the Southeast quarter of the South- east quarter of Fractional Section 18, Township 6 South, Range 10 West, in the Rancho Las Bolsas, as shown on a map recorded in book 51, page 14 of Miscellaneous Maps, records of Orange County, California, described as follows : Beginning at the Northwest corner of said South- east quarter of the Southeast quarter of Section 18 being the Southeast corner of Tract No. 5017, as shown on a map recorded in book 239, pages 5 and 6 of Miscellaneous Maps , records of Orange County, er7 1. California; thence along the North line of said Southeast quarter of the Southeast quarter of Section 18, North 89°37' 18" East 751. 16 feet to a point distant 351. 57 feet measured South 89°37' 18" West there along from the Westerly line of Brookhurst Street , 80. 00 feet wide, as described in a deed to said County of Orange, recorded June 17, 1953 in book 2522, page 502 of Official Records and which point is a point in a curve concentric with said Westerly line of Brookhurst Street, concave North- westerly having a radius of 2830 feet and from which point a radial bears South 69000 ' 36" East; thence along said concentric curve Southeasterly 651. 08 feet through a central angle of 13010154" to a point in a line parallel with the Northerly line of the Southeast quarter of the Southeast quarter of said Section 18, from which point a radial bears South 53049142" East; thence along said parallel line South 89037' 18 West 294. 11 feet; thence South 00°37' 30" East 26. 00 feet; thence South 89°37118" West 150. 00 feet to the Northeast corner of Lot 132 of Tract No. 5424, as shown on a map recorded in book 236, pages 18 and 19 of Miscellaneous Maps, records of Orange County, California; thence along the Easterly line of said Tract No. 5424, North 00°37' 30" West 26. 00 feet to the East Northeasterly corner of said Tract, being the point of intersection of the Norther- ly line of Surfcrest Drive, 26. 00 feet wide in said Tract and the West line of said Southeast quarter of the Southeast quarter of Section 18; thence along said West line North 00037130" West 573. 84 feet to the point of beginning. Excepting therefrom all oil, gas, minerals and other hydrocarbon substances lying below a depth of 500 feet from the surface of said land but without the right of entry upon any portion of the surface above a depth of 500 feet to take, market, mine, explore or drill for same. SECTION 2 . The Planning Director of the City of Huntington Beach is hereby directed to change District Map 20 (Sectional District Map 18-6-10) to incorporate the zone change described in Section 1 hereof, and as said district map shall have been amended, the same shall be in full force and effect and be a part of the Huntington Beach Ordinance Code. A copy of said district map, as amended hereby, is available for inspection in the office of the City Clerk. 2. SECTION 3. Section 9061, District Map 20 thereof, is hereby amended by Zone Case No. 75-06. SECTION 4 . This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the pas- sage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News , a weekly newspaper of general circulation, printed and published in Huntington Beach, California.
