HomeMy WebLinkAboutOrdinance #2019 ORDINANCE NO. 2019 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR CHANGE OF ZONING ON REAL PROPERTY LOCATED SOUTH OF EDINGER AVENUE, APPROXIMATELY 1200 FEET WEST OF TRINIDAD LANE TO THE TERMINUS OF EDINGER AVENUE (ZONE CASE NO. 75-08) WHEREAS, pursuant to the state Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Change No. 75-08 wherein both bodies have carefully considered all information presented at said hearings, and after due con- sideration of the findings and recommendations of the Planning Commission and all evidence presented to said City Council, the City Council finds that such zone change is proper, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows : SECTION 1 . The following described real property located south of Edinger Avenue, approximately 1200 feet west of Trinidad Lane and continuing to the terminus of Edinger Avenue is hereby changed from Rl, "Low Density Residential District, " to C2, "Community Business District : " That portion of fractional Section 19, Township 5 South, Range 11 West, in the City of Huntington Beach, County of Orange, State of California, as per map recorded in Book 51, Page 13, of Miscella- neous Maps in the office of the County Recorder of said County and more particularly described as follows : Beginning at the most southerly corner of the boundary of the Flood Control outlet Parcel 1012-2, as shown on Orange County Harbor District Map No. S 10. 3-1; thence along the southwesterly prolongation of the southeasterly line of said parcel, south 49034 ' 33" west 682. 85 feet to a point in the northerly JOC :cs 1. line of Strip "A" as described in the deed to the State of California recorded in Book 6368, Page 411 of Official Records of said County Recorder said point hereinafter referred to as point "A; " thence along said northerly line south 61000, 00" east 824 . 02 feet; thence north 3504411111' east 358 . 78 feet; thence north 54015t49" west 95. 00 feet ; thence north 18000' 33" west 641. 89 feet to a point in said southeasterly line of Parcel 1012-2, said point being distant thereon north 49034 ' 33" east 860. 00 feet from said point "A; " thence along said southeasterly line south 49034 ' 33" west 177 .15 feet to the point of beginning. Excepting therefrom that portion lying within the 2. 95 more or less Acre Parcel of land vested in the State of California. Containing an area of 9. 066 acres more or less . SECTION 2. The following described real property located south of Edinger Avenue, approximately 1200 feet west of Trinidad Lane and continuing to the terminus of Edinger Avenue is hereby changed from Rl, "Low Density Residential District, " to R2, "Medium Density Residential District : " That portion of fractional Section 19, Township 5 South, Range 11 West, in the City of Huntington Beach, County of Orange, State of California, as per map recorded in Book 51, Page 13 of Miscella- neous Maps in the office of the County Recorder of said County and more particularly described as follows : Commencing at the most southerly corner of the boundary of the Flood Control outlet Parcel 1012-2, as shown on Orange County Harbor District Map No. S 10. 3-1; thence along the southwesterly prolongation of the southeasterly line of said Parcel south 490 34 '33" west 682 . 85 feet to a point in the northerly line of Strip "A" as described in the deed to the State of California recorded in Book 6368 , Page 411 of Official Records of said County Recorder said point hereinafter referred to as point "A; " thence along said northerly line south 61000, 0011 east 824 . 02 feet; thence north 35044111" east 358 . 78 feet to the true point of beginning; thence north 54015149" west 95 . 00 feet; thence north 18000' 33" west 641. 89 feet to a point in said southeasterly line of Parcel 1012-2, said point being distant 2. thereon north 49034 ' 33" east 860. 00 feet from said point "A;" thence along said southeasterly line north 49° 34' 33" east 722 . 85 feet and north- easterly 376. 15 feet along a curve concave southerly having a radius of 865 . 00 feet through a central angle of 24054156" to the westerly pro- longation of the northerly line of Tract No . 8005, as per map recorded in Book 318, Pages 9 through 16 inclusive, of said Miscellaneous Maps, Records of said County; thence along said parallel line north 89038126" east 46. 88 feet ; thence south 00 13'53" west 709. 05 feet to a point on a non- tangent curve concave southerly having a radius of 500. 00 feet the southwesterly terminus of said curve being tangent to the northeasterly prolonga- tion of that certain course herein cited as "north 35144 ' ll" east 358 . 78 feet; " thence southwesterly 432. 00 feet along said curve through a central angle of 49030 '13"; thence tangent to said curve south 35044 , 11" west 486 . 22 feet to the true point of beginning. Containing an area of 14 . 645 acres more or less . SECTION 3 . The Planning Director of the City of Huntington Beach is hereby directed to change District Map 21 (Sectional District Map 19-5-11) to incorporate the zone changes described in Sections 1 and 2 hereof, and as said district map shall have been amended, the same shall be in full force and effect and be a part of the Huntington Beach Ordinance Code. A copy of said district map, as amended hereby, is available for inspection in the office of the City Clerk. SECTION 4 . Section 9061, District Map 21 thereof, is hereby amended by Zone Case No . 75-08 . SECTION 5 . This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the pas- sage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News, a weekly newspaper of general circulation, printed and published in Huntington Beach, California. 3 • PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 3rd day of November, 1975.
