HomeMy WebLinkAboutOrdinance #2041 ORDINANCE NO. 2041 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY ADDING SECTIONS 9730. 4 . 1 AND 9730 . 4 . 2 THERETO PERTAINING TO WAIVER OF STREET IMPROVEMENTS The City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The Huntington Beach Ordinance Code is hereby amended by adding thereto Sections 9730. 4 . 1 and 9730 . 4 . 2 to read as follows : 9730. 4 . 1 . WAIVER OF STREET IMPROVEMENTS . The Director of Building and Community Development is authorized to waive the requirements of Section 9730 . 4 and to issue a certificate of occupancy to any applicant therefor in the following circum- stances and upon the following conditions : (a) the certificate of occupancy would be issued excepting for completion of minor items of street improvement , and (b) the Director of Public Works has found that : (1) the applicant has an urgent need to occupy the premises prior to completion of all items of work; (2) the interest of the City in having all such minor improvements completed prior to the issuance of the occupancy permits is adequately safeguarded; (3) the applicant has deposited with the Finance Department a sum of money equal to one hundred fifty percent (150%) of the Public Works Director' s estimate of the cost of the improve- ments the completion of which the waiver is sought ; and ( 4) the applicant has agreed with the City in writing that the deposit required by subsection (3) may be used by the City after an agreed upon time to complete the waived requirements if the applicant has not completed such requirements within such time. The remainder of such deposit , if any, shall be returned to the applicant upon completion of the improvementsby the City. 9730. 4 . 2 , APPLICATIONS . The Director of Public Works is authorized to receive applications from persons desiring waivers WSA: cs 1, of the street improvement requirements of Section 9730 . 4 and to enter the required written agreements with such applicants . A non-refundable fee of Fifty Dollars ($50) shall accompany each such application. SECTION 2. This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News , a weekly news- papers of general circulation, printed and published in Huntington Beach, California.
