HomeMy WebLinkAboutOrdinance #2067 EMERGENCY ORDINANCE NO. 2067 AN EMERGENCY ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH MUNICIPAL CODE BY ADDING CHAPTER 7. 12 THERETO PERTAINING TO ANIMAL CONTROL The City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The Huntington Beach Municipal Code is hereby amended by adding thereto Chapter 7.12, entitled "Miscellaneous Animal Care and Control," to read as follows : Chapter 7 . 12 MISCELLANEOUS ANIMAL CARE AND CONTROL 7 .12. 010 Bees . (a ) No person shall keep or maintain, or suffer or permit to be kept or maintained, upon premises owned or controlled by him in the city, any hive bees within two hundred (200) feet of any dwelling house of the owner or person in control of such bees . This section shall not apply to the keeping of bees within an educational institution for study or observation, or within a physician' s office or labora- tory for medical research, treatment, or other scientific purposes , provided they are not permitted to fly at large . (b) A violation of this section is an infraction, and upon a conviction thereof shall be punishable by a fine not to exceed One Hundred Dollars ($100) . SECTION 2. This is an emergency ordinance necessary for the immediate preservation of public peace, health or safety inasmuch as the City of Huntington Beach has repealed its animal control ordinances except for Chapter 7 . 08 pertaining to dog and cat licensing and Chapter 7. 04 adopting Title 4, Division l of the Codified Ordinances of the County of Orange excepting Articles 4 and 5. By this action the City 'has minimum animal control ordinances but at the present time has no means of controlling animals other than dogs and cats . Pursuant to Section 511 of the Huntington Beach City Charter, this ordinance shall become effective upon adoption. WSA: cs 1. SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause same to be published within fifteen days of its passage in the Huntington Beach News, a newspaper of general circulation, printed and published in Huntington Beach, California.
