AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH MUNICIPAL CODE
BY AMENDING SECTION 3 . 28.090 PERTAINING TO
TRANSIENT OCCUPANCY TAX
The City Council of the City of Huntington Beach does
ordain as follows :
SECTION 1. The Huntington Beach Municipal Code is hereby
amended by amending Section 3 .28.090 to read as follows :
3. 28. 090 Reporting and remitting. Each operator shall
file a report each month on forms provided by the city treasurer
of the total rents charged and received and the amount of tax
collected for transient occupancies for the preceding month.
The full amount of tax collected shall be remitted to the city
treasurer. Said tax, collected by each operator during a
calendar month, is due and payable on the last day of the first
month following and shall be delinquent and subject to the
penalties noted in Section 3 .28.100 of this chapter on the first
day of the second month following. Said report shall be filed at
the same time the tax is remitted. Returns are due and payable
and delinquent immediately upon cessation of business for any
reason. All taxes collected by operators pursuant to this
chapter shall be held in trust for the account of the city
until payment is made to the city treasurer.
SECTION 2 . The ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the pas-
sage of this ordinance and cause same to be published within
fifteen days after adoption in the Huntington Beach News , a
weekly newspaper of general circulation, printed and published
in Huntington Beach, California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 16th
day of August, 1976 .

Clerk of the City of Huntington Beach and ex-officio Clerk of the
City Council of the said City, do hereby certify that the whole number
of members of the City Council of the City of Huntington Beach is seven;
that the foregoing ordinance was read to said City Council at a regular
meeting thereof held on the 2nd day of August,
19 76 , and was again read to said City Council at a regular
meeting thereof held on the 16th day of Auaust 19 76 and
was passed and adopted by the affirmative vote of more than a majority of
all the members of said City Council.
