ORDINANCE NO. 2104
AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY REPEALING SECTIONS 9162. 3.1, 9202. 3.1.3,
9232 . 3.1. 3 AND 9514 . 5, RENUMBERING ARTICLE
938, AMENDING SECTIONS 9362.10, 9513.1 AND
9791(d) , AND ADDING SECTIONS 9161.4, 920.1. 4
AND 9231. 8, ALL RELATING TO VARIOUS PROVISIONS
AND REGULATIONS OF DIVISION 9
The City Council of the City of Huntington Beach does
ordain as follows :
SECTION 1. The Huntington Beach Ordinance Code is hereby
amended by repealing Sections 9162. 3.1, 9202 .3. 1 . 3, 9232 . 3 .1 .3,
and. 9514.5 thereof.
SECTION 2 . The Huntington Beach Ordinance Code is hereby
amended by renumbering Article 938, entitled "Townlot Specific
Plan - Area One," to Article 935, "Townlot Specific Plan - Area
One. "
SECTION 3. The Huntington Beach Ordinance Code is hereby
amended by amending Sections 9362.10, 9513.1, and 9791(d) thereof
to read as follows :
9362.10 . BUILDING BULK. All structures proposed to be
constructed within a project shall conform to the following
requirements :
(a) Structures having dwelling units attached side by
side shall be composed of not more than six (6) dwelling units .
(b) Structures having dwelling units attached side by
side shall have an offset in the front building line of at
least four ( 4) feet for every two (2) dwelling units within
such structure .
(c ) Structures having dwelling units attached side by
side shall have at least one-third (1/3) of the total number of
units within such structures constructed of one-story units ,
except , where structures are predominantly of three (3) stories,
one-third (1/3) of the total number of units shall be within
structures of two (2) stories or less in height.

9513. 1. FRONT YARD AND EXTERIOR SIDE YARD SETBACK. The
minimum front yard set back and the minimum exterior side yard
setback shall comply with the following requirements :
(a) Parcels that front on a major, primary or secondary
highway shall have an average minimum front and average minimum
exterior side yard setback of twenty (20) feet, with a minimum
dimension of ten (10) feet . Provided further that for each
additional ten (10) feet of building length exceeding one hundred
and fifty (150) feet, an additional foot of setback shall be pro-
vided, however, the maximum setback need not exceed thirty ( 30)
feet . Parking shall be restricted to the fifty percent (50% )
of said yard requirements closest to the structure . The remain-
ing fifty percent (50%) of the required front and side yards
shall be landscaped.
(b) Parcels that front on a local street shall have a
minimum front and a minimum exterior side yard setback of ten
(10) feet. Provided further that for each additional ten (10)
feet of building length exceeding one hundred and fifty (150)
feet , an additional foot of setback shall be provided, however,
the maximum setback need not exceed twenty (20) feet .
(c ) All required front and exterior side yard setbacks
shall be landscaped and shall be developed and maintained in
accordance with the adopted landscape standards on file in the
Department of Public Works .
(d) One (1) additional foot of setback for each foot of
building height above twenty-five (25) feet shall be provided.

SECTION 4. The Huntington Beach Ordinance Code is hereby
amended by adding thereto Sections 9161. 4 , 9201 . 4, and 9231. 8
to read as follows :
9161. 4. USES SUBJECT TO A USE PERMIT.
(a) Prior to construction of dwelling units abutting an
arterial highway, a use permit shall first be obtained pursuant
to the provisions of Article 981.
(b ) Where five (5) or more dwelling units are proposed for
construction, a use permit shall first be obtained pursuant to
the provisions of Article 981. Approval of such use permit shall
be contingent upon the developer' s compliance with all the
criteria contained in the current standards for apartment
development .
9201. 4 . USES SUBJECT TO A USE PERMIT.
(a) Prior to construction of dwelling units abutting an
arterial highway, a use permit shall first be obtained pursuant
to the provisions of Article 981.
(b ) Where nine (9) or more dwelling units are proposed
for construction, a use permit shall first be obtained pursuant
to the provisions of Article 981. Approval of such use permit
shall be contingent upon the developer's compliance with all the
criteria contained in the current standards for apartment develop-
ment .
9231. 8. USES SUBJECT TO A USE PERMIT.
(a) Prior to construction of dwelling units abutting an
arterial highway, a use permit shall first be obtained pursuant
to the provisions of Article 981.
(b) Where fifteen (15) or more dwelling units are proposed
for construction, a use permit shall be obtained pursuant to the
provisions of Article 981. Approval of such use permit shall be
contingent upon the developer' s compliance with all the criteria
contained in the current standards for apartment development .
SECTION 5 . This ordinance shall take effect thirty days
after its passage . The City Clerk shall certify to the passage
of this ordinance and cause same to be published within fifteen
days after adoption in the Huntington Beach News , a weekly news-
paper of general circulation, printed and published in Huntington
Beach, California.

PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 16th
day of August, 1976.

19 76 , and was again read to said City Council at a regular
meeting thereof held on the 16th day of August 1976 and
was passed and adopted by the affirmative vote of more than a majority of
all the members of said City Council.
