9382, DEFINITIONS. For the purpose of this article,
the following words and phrases shall have the meanings here-
inafter set forth:
(a) Arterial shall mean any street, highway, or road
having been designated as an arterial on the Master Plan of
Arterial Streets and Highways and having a minimum right of
way of eighty (80) feet .
(b) Dwelling unit shall mean a single unit providing
complete, independent living facilities for a family including
permanent provisions for living, sleeping., eating, cooking, and
sanitation.
(c ) Floor area shall mean the area of the several
floors of a structure or structures measured from the exterior
faces of the exterior walls, or from the centerline of walls
separating two buildings . All enclosed stairways and corridors
are included as part of the floor area. Attics, garages,
parking structures, or decks are not included as floor area.
(d) Open 6pace shall mean the site area minus the site
coverage and minus the area of the site devoted to garages or
parking structures , driveways and other open parking areas .
(e) Local street shall mean a low speed, low volume
highway primarily used as access to residential, business or
other abutting property.

(f) Recreation space (Private) shall mean the portion of
the reauired open space that is used for private outdoor
purposes by inhabitants of individual units . Such private
recreation space shall relate directly to and be attached to
the individual units they are intended to serve .
W Site area shall mean the legally created parcel of
land bounded by property lines after dedication.
(h) Site coverage shall mean the area of the site
covered by structures measured from an imaginary vertical
projection of the surface area encompassed within the exterior
faces of the exterior walls or from the centerline of walls
separating two buildings . All roofed covered structures
including garages and parking structures , stairways , balcony
brojections, covered patios and interior corridor shall be
included.
(i) Site frontage shall mean the smallest dimension of the
site adjacent to a public street .
U ) Unenclosed Patios, Balconies , and Decks shall mean a
private area attached to a dwelling unit that is fully open to
the sky and open at least fifty (50%) percent on one side . Un-
enclosed patios, balconies, and decks shall have a minimum dimen-
sion of six (6) feet .
9384 .10 . OPEN, UNENCLOSED STAIRWAYS OR BALCONIES . Open,
unenclosed stairways or balconies, not covered by a roof or a
canopy, may extend a maximum of four (4 ) feet into the required
front yard and may extend into the required side yard not to
exceed a minimum of three (3) feet from the property line.
Balconies shall be located to provide at least fifty (50%)
percent offset from balconies, patios or decks of existing
abutting buildings . Such stairways or balconies shall maintain
a minimum distance of five (5) feet from any portion of any
other building on the site or adjacent sites .
9384 .15 APPEARANCE STANDARDS. In order to create struc-
tures which insure enhancement of their sites and are aestheti-
cally harmonious with improvements in the Townlot Area, the
following standards will apply:
(a) Architectural features and general appearance of the
proposed development shall not impair the orderly and harmoni-
ous development of the area, the occupancy thereof, or the
community as a whole .
(b) Architectural features, including materials, colors .
and variations in setback shall be included in the design of
all vertical exterior surfaces of the buildings in order to

create an interesting, aesthetically pleasing project when
viewed from outside the project as well as within. Building
facades and exterior walls fronting or siding on public rights-
of-way shall not consist of blank walls only.
(c ) Architectural features , including materials and
colors, as well as landscaping elements, including trees,
shrubs, and ground cover, shall be included in the design of
the rear elevation of the structures in order to create an
interesting and aesthetically pleasing appearance from the
rear entrance of the project and alleys .
(d) Any building exceeding fifty (50) feet in length shall
have a minimum variation of two (2) feet setback in the exterior
sidewall for each fifty (50) feet of building length, except that
the setback is not applicable to a common zero sideyard wall
of the structures .
(e) Variations of architectural design and appearance
shall be applied where more than one lot is proposed for new
construction and where more than one main structure is proposed.
Identical facades shall not be permitted on adjacent buildings .
(f) Items such as mechanical equipment , utility fixtures
and refuse containers shall be screened from street view. Trash
areas shall have an enclosure of sufficient height to screen
refuse receptacles from view. All such trash enclosures shall
be constructed of materials which blend with the architectural
and aesthetics of the main structure.
9384 .16 . APPLICATION REQUIREMENTS. All uses in the Townlot
Specific Plan Area One shall be subject to an administrative review
application before the Board of Zoning Adjustments unless a use
permit or a conditional use permit application is required. The
following criteria shall serve as guidelines for the Board in
approving, conditionally approving, or denying such applications :
(a) Relationship of the structures to the site, including
setbacks and site
planning.
(b) Compatibility of structures with surroundings .
(c ) Relationships of the open space to the dwellings .
(d) Landscaping.
(e) Relationship of parking and vehicular and pedestrian
circulation areas .
9385.3 DEVELOPMENT INTENSITY. The maximum development
intensity for each site developed within Section A of Townlot
Specific Plan - Area One shall comply with the provisions of
the following development intensity standards table :

9385. 4 RECREATION SPACE DIMENSIONS AND LOCATION. Any
recreation space provided in accordance with Section 9385. 3
shall have a minimum dimension of six (6) feet and shall be
provided with each dwelling unit in accordance with the follow-
ing minimum space requirements :
four (4) bedrooms 300
three (3) bedrooms 250
two (2) bedrooms 150
one (1) bedroom 150
single or 'bachelor 100
Balconies that serve as entrances or exits for more than
one dwelling unit shall not be considered as private open space.
All required recreation areas shall be located behind the
required front yard setback.
9385. 8 SIDE YARD SETBACK FOR TWENTY-FIVE (25) FOOT LOTS.
(a) The side yard set back for a twenty-five (25) foot
frontage lot shall be a minimum of three (3 ) feet, provided
further, that a zero setback is permitted if the following con-
ditions are complied with:

(1) the abutting site is held under the same owner-
ship at the time of initial construction or the owners of abut-
ting properties record an agreement or deed restriction and
consent in writing to such zero setback; and
(2) A minimum front yard setback of twelve (12) feet
shall be provided for all structures; and
(3) where a common zero setback line is used between
two abutting structures, a minimum offset of six (6) feet shall
be provided in the front setback of the abutting structures; and
(4) the opposite side yard of the site shall be
not less than four (4) feet; and
(5) adjacent structures on abutting lots shall maintain
a minimum separation of five (5) feet, provided further, this
requirement shall not apply where the same interior property line
is utilized for zero side yard setback construction on both lots.
(b) Any side yard setback on a twenty-five (25) foot lot
with frontage abutting an arterial or local street shall be a
minimum of five (5) feet .
9386.3 DEVELOPMENT INTENSITY. Except where otherwise, pro-
vided, the maximum development intensity for each site developed
in Section B of Townlot Specific Plan - Area One shall comply
with the provisions of the following development intensity
standards table:

9386 . 4 RECREATIONAL SPACE DIMENSIONS AND LOCATION. Any
recreation space provided in accordance with Section 9386. 3
shall have a minimum dimension of six (6) feet and shall be
provided with each dwelling unit in accordance with the follow-

four bedrooms 300 sq. ft .
three bedroom units 250 sq. ft .
two bedroom units 200 sq. ft .
one bedroom unit 150 sq . ft .
single 100 sq. ft .

one dwelling unit shall not be considered as private open space.
All required recreation areas shall be located behind the
required front yard setback.
SECTION 3 . The Huntington Beach Ordinance Code is hereby
amended by adding Sections 9384 .17 and 9384 .18 to read as follows :
9384 .17 LANDSCAPING. In order to provide and insure a
more pleasant living environment through the use of plants,
vegetation and decorative landscape/architectural design elements,
the following are required:
(a) All front and side yard setback areas visible from
streets shall be permanently landscaped with ground cover, ferns,
trees , shrubs and other living plants .
(b) A minimum of one (1) twenty-four (24) inch box size tree
shall be provided in the front yard area for each fifty (50 ) feet
of site frontage. As an alternative, three (3) or more small trees
may be located and grouped in any desired way on the site.
(c ) A permanent irrigation system shall be provided in all
landscaped areas .
(d) A landscape and irrigation plan shall be submitted to
the Department of Building and Community Develppment prior to
the issuance of building permits .
EXCEPTION. Single family homes are excluded from landscaping
requirements as set forth in this section.
9384 .18 DISTANCE BETWEEN THE MAIN STRUCTURE AND ACCESSORY
BUILDING. The minimum distance between the exterior walls of a
main structure and accessory building on the same lot shall be
ten (10) feet .

SECTION 4 . This ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the passage
of this ordinance and cause same to be published within fifteen
days after adoption in the Huntington Beach News, a weekly 'news-
paper of general circulation, printed and published in Huntington
Beach, California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 16,th
