HomeMy WebLinkAboutOrdinance #2113 ORDINANCE N0. 2113 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9730 . 21 PERTAINING TO HOME OCCUPATIONS The City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The Huntington Beach Ordinance Code is hereby amended by amending Section 9730 .21 to read as follows : 9730 . 21. HOME OCCUPATIONS. CONDITIONS. Home occupations may be permitted in mobile home parks and in the Rl, R2, R3 and R4 districts provided the following conditions are met: (a) Business shall be restricted to one room in the dwelling and all material, equipment or facilities shall be kept therein; provided further, swimming instruction may be conducted in an outdoor pool. (b) Garages shall not be used in connection with such business except for parking of business vehicles . (c ) Only persons residing on the premises may be employed. (d) There shall be no display of merchandise, projects, operations , signs , or nameplates of any kind visible from out- side the dwelling. (e) The appearance of the dwelling shall not be altered, nor the operation of the business within the dwelling be such that the dwelling may be recognized as serving a nonresidential use, whether by colors , materials, construction, lighting, win- dows , signs , sounds , or any other means . (f) No storage of materials , supplies , equipment or products outside the one room of the dwelling used for a home occupation shall be permitted. (g) The occupation shall not be of a type which generates 1. JOC : ahb ill pedestrian or vehicular traffic beyond that which is normal to the particular neighborhood. (h) The occupation shall not involve the use of 'commercial vehicles for delivery of materials to or from the premises. (i) No marked commercial vehicle- or equipment used in con- junction with the occupation shall be parked overnight on the street or within the front yard setback of the premises . (j ) The occupation shall not create noise, odor, dust, vibration, fumes , or smoke readily discernible at the bound- aries of the parcel on which it is situated, and shall not create any disturbance which adversely affects electrical ap- pliances located on adjacent properties . (k) All provisions of the Uniform Fire Code shall be met . (1) A home occupation permit for swimming instruction shall be subject to approval of an administrative review. Hearings, time limits , and revocation proceedings on the administrative review shall be conducted in accordance with Sections 9730. 27. 3 through 9730. 27. 6 of this article. (m) Swimming instructions shall be limited to a maximum of four (4) students at any one time. All students attending a ses- sion must be transported to the premises by not more than two (2) motor vehicles . (n) Evidence of liability insurance to protect any person from damages for bodily injury or death arising out of the use of the premises for swimming instruction pursuant to said permit in the minimum amount of One Hundred Thousand Dollars ($100 ,000) shall be filed with the city prior to issuance of a home occupa- tion permit . Any violation of the above conditions or other conditions for approval of a home occupation shall be cause for revocation of the authorization to conduct said occupation, and such oc- cupation shall cease immediately upon revocation. SECTION 2 . This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News , a weekly news- paper of general circulation, printed and publishing in Huntington Beach, California. 2.
