AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY AMENDING SECTION 9970 THEREOF, PERTAINING
TO IMPROVEMENT SECURITY REQUIRED
The City Council of the City of Huntington Beach does
ordain as follows :
SECTION 1. The Huntington Beach Ordinance Code is hereby
amended by amending Section 9970 to read as follows :
9970 • IMPROVEMENT SECURITY REQUIRED. Any improvement
agreement , contract or act required or authorized by the
Subdivision Map Act , for which security is required, shall be
secured, in accordance with Section 66899 . 3 of the California
Government Code, as follows:
One hundred percent of the total estimated cost of the
improvement or of the act to be performed, conditioned upon the
faithful performance of the act or agreement; and
An additional amount of 50 percent of the total estimated
cost of the improvement or the performance of the required act,
securing payment to the contractor, his subcontractors, and to
persons furnishing labor, materials or equipment to them for
the improvement or the performance of the required act .
An additional amount of 10 percent of the total actual
cost of the improvement or the performance of the required act
for the guarantee and warranty of the work for a period of
one year following the completion and acceptance thereof against
any defective work or labor done, or defective materials furnished.
SECTION 2 . This ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the passage
of this ordinance and cause same to be published within fifteen
days after adoption in the Huntington Beach News , a weekly news-
paper of general circulation, printed and published in Huntington
Beach, California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at an adjourned regular meeting thereof held

was passed and adopted by the affirmative vote of more than a majority of
all the members of said City Council.
