AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY AMENDING AND ADDING CERTAIN SECTIONS ALL
PERTAINING TO DEDICATION OF STREET RIGHTS-OF-
WAY
The City Council of the City of Huntington Beach does
ordain as follows :
SECTION 1. The Huntington Beach Ordinance Code is hereby
amended by amending Sections 9103, 9106 .2, 9155, 9163, 9166 .5,
9203, 9206.5 , 9233, 9236 .5 , 9404. 3, 9434 , 9457, 9532, 9555, 9603,
9606. 2, 9614, 9633, 9685 .5, 9700 .19, 9730 .3 and 9787.1 thereof
to read as follows :
9103. YARD REQUIREMENTS. All yards shall be measured
from the existing property lines or from the ultimate right-of-
way lines as required by Article 973•
9106. 2. SETBACK FROM A STREET. Any carport or garage
entered directly from a street shall set back a minimum of
twenty-two (22) feet from the ultimate right-of-way of said
street.
9155 . YARD REQUIREMENTS. All yards shall be measured from
the existing property lines or from the ultimate right-of-way
lines as required by Article 973•
9163. YARD REQUIREMENTS. All yards shall be measured
from the existing property lines or from the ultimate right-of-
way lines as required by Article 973•
9166. 5. SETBACK FROM A STREET. Any carport or garage
entered directly from a street shall set back a minimum of
twenty-two (22) feet from the ultimate right-of-way of said
street .
9203. YARD REQUIREMENTS. All yards shall be measured
from the existing property lines or from the ultimate right-of-
way lines as required by Article 973•

9532 . YARD AND HEIGHT REQUIREMENTS. All yards shall be
measured from the existing property lines or from the ultimate
right-of-way lines as required by Article 973.
9555 . YARD REQUIREMENTS. All yards shall be measured
from the existing property lines or from the ultimate right-of-
way lines as required by Article 973.
9603. RA ZONE, YARD REQUIREMENTS. All yards shall be
measured from the existing property lines or from the ultimate
right-of-way lines as required by Article 973.
9606. 2. SETBACK FROM A STREET. Any carport or garage
entered directly from a street shall set back a minimum of
twenty-two (22) feet from the ultimate right-of-way of said
street.
9614. YARDS. All yards shall be measured from the existing
property lines or from the ultimate right-of-way lines as required
by Article 973.
The following yards shall be provided and maintained in case
of a dwelling or apartment, and where there is a question as to
which side or end of the lot is the front, side or rear line of
the lot , the Building Inspector or his deputy is hereby authorized
to make the determination; provided, however, that on lots having
an area of less than five acres , the narrowest side abutting a
street shall be considered the front lot line .

9633. YARD REQUIREMENTS. The yard requirements shall
pertain to all structures that relate to equines including but
not limited to stalls , corrals, arenas and fly-tight manure bins ,
except pastures or grazing areas . All such structures shall
maintain a minimum distance of one hundred (100) feet from any
dwelling unit other than a unit on subject property that is used
for human habitation.
All yard requirements shall be measured from the ultimate
right-of-way line.
The following setback requirements shall apply:
(a) Front . The front yard setback shall be a minimum of
fifty (50) feet.
(b ) Interior Side. The interior side yard setback shall be
a minimum of twenty-five (25) feet, except that the interior side
yard setback shall be a minimum of fifty (50 ) feet for one equine
and one hundred (100 ) feet for two or more equines from any
property line that is coterminous with property that is residen-
tially used, or master planned for residential use.
(c) Exterior Side . The exterior side yard setback shall
be a minimum of fifty (50) feet.
(d) Rear. The rear yard setback shall be a minimum of
twenty-five 25 ) feet , except the rear yard setback shall be a
minimum of fifty (50) feet for one equine, one hundred (100 ) feet
for two or more equines from any property line that is cotermi-
nous with property that is residentially zoned, residentially
used or master planned for residential use.
9685 .5 . DEDICATION OF RIGHT-OF-WAY WHEN ABUTTING ANY
HIGHWAY, STREET OR ALLEY. Prior to issuance of a drilling
permit for a new well located on any 1101" parcel abutting a
public street, alley or highway, the street , alley or highway
abutting such parcel shall be dedicated to the City of Huntington
Beach to a width determined by the following:
(a) Department of Public Works ' standard plans;
(b ) A precise plan of street , highway or alley alignment .
9700 .19 . Words beginning with the letter "U" shall have
the following definitions :
(1) Ultimate Right-of-Way shall mean the latest adopted
maximum width for any street , alley or thoroughfare as established

by the Circulation Element of the General Plan, a precise plan
of street or alley alignment, Department of Public Works '
standard plans or by recordation of a final or parcel map .
(2) Use . The purpose for which land or a building or
structure is designed, arranged, or intended or for which it
is , or in the future may be, occupied or maintained.
(3) Utility Trailer. A vehicle, other than a motor
vehicle , which is drawn by a motor vehicle and used to carry,
or capable of carrying property on its own structure .
9730 . 3. RIGHT-OF-WAY DEDICATION DETERMINANTS. Right-of-
way dedication shall be to a width determined by any of the
following:
(a) Department of Public Works ' standard plans ;
(b ) A precise plan of street , highway or alley alignment .
9787. 1. SETBACK REQUIREMENTS. In all districts the minimum
setback line shall be measured from the ultimate right-of-way
line.
SECTION 2. This ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the passage
of this ordinance and cause same to be published within fifteen
days after adoption in the Huntington Beach News, a weekly news-
paper of general circulation, printed and published in Huntington
Beach, California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 7th
day of; February , 1977.

all the members of said City Council.
