AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY AMENDING SECTION 9061 THEREOF TO PROVIDE
FOR CHANGE OF ZONING ON REAL PROPERTY LOCATED
GENERALLY ON THE NORTHEAST CORNER OF BROOKHURST
STREET AND HAMILTON AVENUE (ZONE CASE NO. 76-26

WHEREAS, pursuant to the state Planning and Zoning Law,
the Huntington Beach Planning Commission and Huntington Beach
City Council have had separate public hearings relative to Zone
Case No. 76-26 "H" wherein both bodies have carefully consi-
dered all information presented at said hearings, and after
due consideration of the findings and recommmendations of the
Planning Commission and all evidence presented to said City
Council, the City Council finds that such zone change is
proper, and consistent with the General Plan.
NOW, THEREFORE, the City Council of the City of Huntington
Beach does ordain as follows :
SECTION 1. The following described real property located
generally on the northeast corner of Brookhurst Street and
Hamilton Avenue, is hereby changed from C4, "Highway Commercial"
District to R2-PD, "Two Family Residence, Planned Development"
District :
All that certain land situated in the State of
California, County of Orange, City of Huntington
Beach, described as follows :
PARCEL l:
Lots 1 through 6, both inclusive, Lots 33 through
52, both inclusive, Lots 62, 63, Lots 65 through
75, both inclusive, and Lots A and C of Tract
No. 193, as shown on a Map recorded in Book 12,
page 49 of Miscellaneous Maps, records of Orange
County, California .
Excepting therefrom the West one-half of Lot C
lying between the Easterly prolongation of the
North and South lines of Lots 29, 30, 31 and 32
of said Tract .

Also excepting therefrom that portion of the
West half of Lot C lying between the Easterly
prolongation of the North line of Lot 22 of said
Tract No. 193 and a line parallel with and
50. 00 feet Northerly, measured at right angles
to the following described line:
Beginning at the Southwest corner of the North-
west quarter of Section 17, Township 6 South,
Range 10 West, S. B. B. & M. ; thence North 850
44 , 1511 East 600 feet, more or less.
Also excepting therefrom that portion of the
East half of Lot C lying between the Westerly
prolongation of the North line of Lot 53 of said
Tract No . 193 and a line parallel with and 50 . 00
feet Northerly, measured at right angles to the
following described liner
Beginning at the Southwest corner of the Northwest
quarter of Section 17, Township 6 South, Range 10
West, S. B. B. & M. ; thence North 850 44t 1511 East
600 feet, more or less .
Also excepting from said Lot C that portion thereof
lying Southerly of a line parallel with and 50. 00
feet Northerly, measured at right angles to the
following described line:
Beginning at the Southwest corner of the Northwest
quarter of Section 17, Township 6 South, Range 10
West, S. B. B. & M. ; thence North 851 44, 1511 East
600 feet, more or less .
Also excepting therefrom those portions of said Lots
62, 63 and 65 through 75, both inclusive, lying
Easterly of a line parallel to the Easterly line
of said lots and distant 30. 00 feet Westerly there-
from, measured at right angles .
Also excepting therefrom that portion of said Lot A
lying Easterly of the Northerly prolongation of a
line parallel to the Easterly line of said Lot 75
and distant 30. 00 feet Westerly therefrom, measured
at right angles.
Also excepting from said Lot 34, 45 and from that
portion of the West half of Lot C lying between
the extended North and South lines of said Lot 34
and from that portion of the East half of Lot C
lying between the extended North and South lines
of said Lot 45, an undivided one-third interest
in and to all oil, gas, minerals and other hydro-
carbon substances lying in and under said land
below a depth of 500 feet, measured vertically from

the surface thereof, but without the right of
surface entry, as set forth in Deed from Clare
Schweitzer recorded November 10, 1967 in Book
8432, page 301 of Official Records .
Also excepting from said Lot 34, 45 and from
that portion of the West half of Lot C lying
between the extended North and South lines of
said Lot 34 and from that portion of the East
half of Lot C lying between the extended North
and South lines of said Lot 45, an undivided
one-third interest in and to all oil, gas, minerals
and other hydrocarbon substances lying in and under
said land below a depth of 500 feet, measured ver-
tically from the surface thereof, but without the
right of surface entry, as set forth in Deed from
The Edward Lustgarten Foundation, a non-profit
corporation, recorded November 10, 1967 in Book
8432, page 304 of Official Records.
PARCEL 2.
Lots 1 through 75, both inclusive, and Lots F, G,
D and H of Tract No. 211, as shown on a Map recorded
in Book 13, page 40 of Miscellaneous Maps, records
of Orange County, California.
Excepting therefrom those portions of said Lots 61
through 74, both inclusive, lying Easterly of a
line parallel to the Easterly line of said lots
and distant 30. 00 feet Westerly therefrom, measured
at right angles.
Also excepting therefrom those portions of said
Lot 75 and Lot F lying Easterly of a line parallel
to the Easterly line of said Lot 75 and distant
30. 00 feet Westerly therefrom, measured at right
angles .
Also excepting therefrom that portion of Lot H
lying Easterly of the Northerly prolongation of a
line parallel to the Easterly line of said Lot 61
and distant 30. 00 feet Westerly therefrom, measured
at right angles .
Also excepting therefrom that portion of Lot D
lying Easterly of the Southerly prolongation
of a line parallel to the Easterly line of said
Lot 75 and distant 30 . 00 feet Westerly therefrom,
measured at right angles.
PARCEL 3:
Lots 1 through 50, both inclusive, and Lots I, L
and K of Tract No . 223, as shown on a Map recorded
in Book 14, page 26 of Miscellaneous Maps, records
of Orange County, California.

Excepting therefrom those portions of said Lots 47
through 50, both inclusive, lying Easterly of a
line parallel to the Easterly line of said lots
and distant 30 . 00 feet Westerly therefrom, measured
at right angles.
Also excepting therefrom those portions of said Lots
46 and 45 and 44 lying Easterly of a line parallel
to the Easterly line of said Lot 46 and distant
30 .00 feet Westerly therefrom, measured at right
angles .
Also excepting therefrom that portion of Lot "I" lying
Easterly of the Southerly prolongation of a line paral-
lel to the Easterly line of said Lot 46 and distant
30. 00 feet Westerly therefrom, measured at right
angles .
SECTION 2. The Planning Director of the City of Huntington
Beach is hereby directed to change District Map 19 (Sectional
District Map 17-6-10) to incorporate the zone change described in
Section 1 hereof, and as said district map shall have been
amended, the same shall be in full force and effect and be a
part of the Huntington Beach Ordinance Code. A copy of said
district map, as amended hereby, is available for inspection
in the office of the City Clerk.
SECTION 3. Section 9061, District Map 19 thereof, is hereby
amended by Zone Case No. 76-26 "H" .
SECTION 4. This ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the pas-
sage of this ordinance and cause same to be published within
fifteen days after adoption in the Huntington Beach News, a
weekly newspaper of general circulation, printed and published
in Huntington Beach, California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 7th
day of ,February,1977•

City Council of the said City, do hereby certify that the whole number
of members of the City Council of the City of Huntington Beach is seven
that the foregoing ordinance was read to said City Council at a regular
meeting thereof held on the 17th day of January
1977 , and was again read to said City Council at a regular
meeting thereof held on the 7th day of February 19 77 and
was passed and adopted by the affirmative vote of more than a majority of
all the members of said City Council.
