HomeMy WebLinkAboutOrdinance #2204 tss �G;w t ORDINANCE NO. 2204 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH FINDING AND DECLARING THAT THERE ARE PRIVATELY- OWNED AND MAINTAINED ROADS WITHIN THE CITY WHICH ARE GENERALLY HELD OPEN TO THE PUBLIC FOR PURPOSES OF VEHICULAR TRAVEL TO SERVE COMMERCIAL ESTABLISHMENTS AND PLANNED RESIDENTIAL DISTRICTS, AND AMENDING THE HUNTINGTON BEACH MUNICIPAL CODE BY ADDING THERETO SECTION 10. 40. 270 PERTAINING TO THE MAINTENANCE OF NO PARKING ZONES ON PRIVATE PROPERTY WHEREAS, California Vehicle Code Section 21107. 6 author- izes the City to find and declare by ordinance or resolution that there are privately owned-and maintained roads in the city which are generally held open to the public for purposes of vehicular travel to serve commercial establishments and planned residential districts; and The City Council of the City of Huntington Beach determines that there exists certain commercial establishments and planned residential districts in the city of Huntington Beach which have areas of traffic congestion which are a danger to vehicles and pedestrians and constitute obstructions to emergency vehicles requiring the prohibition of parking; and That written requests for the adoption of this ordinance have been received from owners of commercial establishments and planned residential districts within the city, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows : SECTION 1. Pursuant to California Vehicle Code Section 21107. 6, all provisions of the California Vehicle Code and the Huntington Beach Municipal Code, Chapter 10 . 40, shall apply to those privately-owned and maintained roads that the City Council shall from time to time by resolution designate as having areas of traffic congestion which are a danger to vehicles and pedes- MT:cs 1. trians and constitute obstructions to emergency vehicles requiring the prohibition of parking. SECTION 2. The Huntington Beach Municipal Code is hereby amended by adding thereto Section 10 .40.270 to read as follows : 10. 40. 270 Parking areas on private property--Maintenance --Parking prohibite a The owners of any private property in the city of Huntington Beach, which property has been declared by resolution of the city council to have areas of traffic congestion and a danger to vehicles and pedestrians and an obstruction of emergency vehicles, shall maintain the designated no parking and restricted parking areas by appro- priate signs and/or paint upon the curb surface according to standards established by the director of public works. (b ) When curb markings and/or signs are in place, no operator of any vehicle shall park said vehicle adjacent to any curb marking and/or sign. A violation of this section is an infraction and, upon conviction thereof, shall be punished by a fine not to exceed one hundred dollars ($100) . SECTION 3. This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News, a weekly news- paper of general circulation, printed and published in Huntington Beach, California.
