AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE AND
THE HUNTINGTON BEACH MUNICIPAL CODE BY REPEALING,
AMENDING AND ADDING CERTAIN SECTIONS ALL PERTAINING
TO PROJECTING SUN DECKS AND WINDSCREENS
The City Council of the City of Huntington Beach does
ordain as follows :
SECTION 1. The Huntington Beach Municipal Code is hereby
amended by repealing Sections 17.24 . 040 and 17. 24 .050 thereof.
SECTION 2. The Huntington Beach Municipal Code is hereby
amended by amending Sections 17. 24. 010, 17. 24. 020 and 17.24.030
thereof to read as follows :
17. 24 .010 Construction. Decks projecting beyond the
bulkhead shall meet the following design requirements in addition
to the requirements set forth in Sections 9103.3.4, 9103.3.4 .1
and 9103. 3. 4 .2 of the Huntington Beach Ordinance Code :
(a) Decks shall be designed to sustain a minimum live load
of one hundred (100) pounds per square foot .
(b) There shall be no moment connection between the deck
and the bulkhead.
(c) When constructed of concrete, lightweight aggregate
shall be used.
(d) Projecting decks shall be designed to sustain all dead
loads plus the required live load within the stresses permitted
for the particular materials by the Uniform Building Code. In no
case shall the resultant load on the bulkhead, from dead loading,
exceed 750 pounds per lineal foot . In addition, a maximum equiv-
alent uniform live load of fifty (50 ) pounds per square foot is
permitted. This live load shall be used to account for all
ancillary features incorporated into the deck/patio structure
including but not limited to overlayment, windscreens, and
planters .
(e) Projecting decks are permitted along the bulkhead pro-
vided the total length of the deck along the bulkhead does not
exceed eighty (80) percent of the length of the bulkhead abutting

the lot. No deck segment shall exceed fifty (50) feet in length.
There shall be a minimum ten (10) foot separation between adja-
cent deck segments except where the combined total deck segments
and intervening space does not exceed fifty (50) feet .
(f) The elevation of the top of the deck shall not be
higher than the height of the slab of the ground floor of the
dwelling unit nor be more than eighteen (18) inches above the
top of the bulkhead, whichever is lesser.
17.24 .020 Railing. Railing, not exceeding forty-two (42)
inches in height and capable of withstanding a horizontal force
of twenty- (20) pounds per lineal foot applied to the top of the
railing may be constructed completely surrounding the deck area.
17. 24.030 Windscreen. Windscreens may enclose the entire
deck perimeter within the following structural limitations :
(a) Windscreens may be supported horizontally by bracing to
the main dwelling.
(b) The windscreen shall be designed to withstand a hori-
zontal wind load of ten (10) pounds per square foot .
(c) Except for necessary framing and overhead windbreaks,
all portions of the windscreen above the allowed forty-two (42)
inch railing height shall be open or of clear glass or other
transparent material.
(d) All glass shall comply with the applicable provisions
of Chapter 54 of the Huntington Beach Building Code .
SECTION 3. The Huntington Beach Ordinance Code is hereby
amended by amending Section 9103. 3 .3 thereof to read as follows :
9103.3. 3 . PATIO COVERS IN REAR YARD. Patio covers may be
constructed to within five (5) feet of the rear property line.
Further provided, where rear yard abuts public waterways, said
patio covers may be constructed to the rear property line. For
the purpose of this section, permitted sundecks, windscreens and
covers related thereto shall be considered patios and .patio
covers .
SECTION 4. The Huntington Beach Ordinance Code is hereby
amended by adding thereto Sections 9103.3. 4, 9103. 3 . 4 .1 and
9103. 3. 4. 2 to read as follows :
9103. 3. 4. PROJECTING DECKS ON WATERFRONT LOTS. Decks on
waterfront lots may project beyond the bulkhead subject to the
following conditions :

(a) A deck shall not project more than five (5) feet beyond
the bulkhead or bulkhead line extended.
(b ) A projecting deck shall not encroach into the projection
of any required sideyard setback or easement .
(c) Projecting decks shall not be permanently roofed
overhead. Covers, including but not limited to plastic, canvas,
lattice, beams or fiberglass , are permissible to provide a
windbreak or sunshade .
9103. 3. 4.1. WINDSCREENS ON PROJECTING DECKS . Windscreens
on projecting decks may be constructed to a height not exceeding
eight (8) feet above the finished surface of the deck.
9103.3.4 .2. REMOVAL. The erection of decks and windscreens
which project over city property is declared to be a privilege
and not a vested right . Such privilege may be revoked by the
City for noncompliance with the provisions of the above sections
upon thirty (30) days written notice and, when so revoked,
structures or portions thereof extending over city property may
be removed by the City at its sole discretion and at the expense
of the property owner.
SECTION 5. The provisions of this ordinance insofar as
they are substantially the same as existing provisions of the
Huntington Beach Municipal Code and Huntington Beach Ordinance
Code relating to the same subject matter shall be construed as
restatements and continuations and not as new enactments.
SECTION 6. This ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the passage
of this ordinance and cause same to be published within fifteen
days after adoption in the Huntington Beach News , a weekly news-
paper of general circulation, printed and published in Huntington
Beach, California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 6th
day of September, 1977 . "-
