HomeMy WebLinkAboutOrdinance #2238 t ORDINANCE NO. 2238 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR CHANGE OF ZONING ON REAL PROPERTY LOCATED ON THE SOUTH SIDE OF ELLIS AVENUE AND WEST OF DELAWARE STREET (ZONE CASE NO . 77-17) WHEREAS , pursuant to the state Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Case No. 77-17 wherein both bodies have carefully considered all information presented at said hearings , and after due con- sideration of the findings and recommendations of the Planning Commission and all evidence presented to said City Council, the !f City Council finds that such zone change is proper, and con- I� sistent with the General Plan, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows: SECTION 1. The following described real property located on the south side of Ellis Avenue approximately 620 feet west of Delaware Street is hereby changed from M1-A, "Restricted Manufacturing District ," to R2, "Medium Density Residential District : " In the city of Huntington Beach, county of Orange, Mate of California, Lots 1, 2 and a portion of Lot 3 of Tract No. 37, as shown on a map recorded in Book 9, page 34 of Miscellaneous Maps , records of said county, together with a portion of the southeast quarter of Section 35, Township 5 South, Range 11 West in the Rancho Las Bolsas, as shown on a map recorded in Book 51, page 13 of Miscellaneous Maps, records of Orange County, and more specifically described as follows : MT:cs 1. Beginning at a point on the westerly line of Tract 8192 as shown on a map recorded in Book 343, page 34 of Miscellaneous Maps , records of said Orange County, said point being south 00102125" west 43. 06 feet from the centerline intersection of Ellis Avenue and Huntington Street as shown on said Tract 8192, said point also being on the southerly right of way line of Ellis Avenue, said Ellis Avenue being 42. 00 feet in width; thence south 00002125" west along the westerly line of said Tract 8192, 525. 94 feet ; thence west 614. 50 feet to a point in the west line of the land described in deed to Huntington Beach Company recorded January 12, 1942, in Book 1134, page 154 of Official Records of Orange County; thence north 00002102" east along said west line 413. 02 feet to a point on said southerly right of way line of Ellis Avenue, 42. 00 feet in width, said point also being in a nontangent curve concave northerly having a radius of 1042. 00 feet from said point a radial line bears E north 00119, 14" west ; thence easterly along said curve through a central angle of 19`07 ' 04" , 347. 68 feet to the beginning of a tangent ` reversing curve concave southerly and having a radius of 958. 00 feet; thence easterly along said curve through a central angle of 16044 '39" 347. 68 feet to the point of beginning. The above parcel of land contains 6. 57 acres -snore or less . SECTION 2. The Planning Director of the City of Huntington Beach is hereby directed to change District Map 39 (Sectional District Map 35-5-11) to incorporate the zone change described in Section 1 hereof, and as said district map shall have been amended, the same shall be in full force and effect and be a part of the Huntington Beach Ordinance Code . A copy of said district map, as amended hereby, is available for inspection in the office of the City Clerk. SECTION 3. Section 9061, District Map 39 thereof, is hereby amended by Zone Case No. 77-17. SECTION 4. This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage 2. of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News, a weekly newspaper of general circulation, printed and published in Huntington Beach, California.
