HomeMy WebLinkAboutOrdinance #2251 ORDINANCE NO. 2251 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR CHANGE OF ZONING ON REAL PROPERTY LOCATED ON THE NORTH SIDE OF PACIFIC COAST HIGHWAY BETWEEN MAGNOLIA AND BROOKHURST STREETS (ZONE CASE NO. 77-3 "B" ) WHEREAS, pursuant to the state Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Case No. 77-3 "B" wherein both bodies have carefully considered all information presented at said hearings, and after due con- sideration of the findings and recommendations of the Planning Commission and all evidence presented to said City Council, the CityCouncil finds that such zone change is g proper, and con- sistent with the General Plan, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The following described real property located on the north side of Pacific Coast Highway between Magnolia and Brookhurst Streets is hereby changed from R5, "Office Professional District" to LUD, "Limited Use District : " Those portions of Section 24, Township 6 South, Range 11 West , and of Section 19, Township 6 South, Range 10 West , in the Rancho Las Bolsas in the city of Huntington Beach, county of Orange, state of California as shown on map recorded in Book 51, page 14 of Miscellaneous Maps in the office of the County Recorder of said county described as follows : Beginning at the intersection of the south- easterly line of Newland Street 40. 00 feet wide, as described in deed recorded in Book f MT:ahb � 1. 3693, page 130 of Official Records in said office, with the northeasterly line of the 20 . 00 foot strip of land described in deed to the State of California, recorded in Book 327, page 156 of said Official Records ; thence along said southeasterly line, north 35°33110" east , 105 . 00 feet ; thence south 54126 ' 50" east , 20. 08 feet ; thence south 9126 ' 50" east , 14. 14 feet to a line parallel with and distant 95. 00 feet northeasterly, measured at right angles from said north- easterly line; thence along said parallel line, south 54126, 5211 east , 2720. 02 feet to the point of tangency thereof with a curve concave north- easterly and having a radius of 2000. 00 feet ; thence southeasterly along said curve through an angle of 403213611 , a distance of 158 .59 feet ; thence tangent to said curve, south 58059' 28" east , -573. 75 feet ; thence southeasterly tangent to last described course along a curve concave northeasterly and having a radius of 2000 . 00 feet , through an angle of 812010611 , a distance of 290 .95 feet ; thence tangent to the last de- scribed curve south 67019134" east , 477.20 feet ; thence easterly tangent to last described course along a curve concave northerly and having a radius of 2000. 00 feet , through an angle of 11022131" , a distance of 397. 07 feet; thence tangent to last described curve, south 78142105" east , 1030. 49 feet to the southwesterly line of the parcel of land described in deed to the Orange County Flood Control District, recorded in Book 5661, page 504 of said Official Records; thence southeasterly along said southwesterly line to the southwesterly line of the parcel of land conveyed to A. C. Thorpe by deed recorded in Book 302, page 69 of Deeds in said office; thence southeasterly along said last mentioned south- westerly line to the center line of Brookhurst Street (formerly Wright Street ) as described in deed to the County of Orange recorded in Book 2535, page 578 of said Official Records; thence southwesterly along said center line of Brookhurst Street to the northeasterly line of the 30 foot strip of land conveyed to the State of California by Final Decree of Condemnation in Case No. 26598 of the Superior Court of Orange County, a certi- fied copy of said Decree being recorded in Book 611, page 99 of said Official Records; thence northwesterly along said last mentioned north- I 2. easterly line to the westerly line of the south- easterly quarter of Section 13 of said Township 6 South, Range 11 West; thence southerly along said westerly line to said first mentioned northeasterly line; thence northwesterly along said first mentioned northeasterly line to said point of beginning. EXCEPTING that portion thereof included within said Brookhurst Street . ALSO EXCEPTING that portion thereof lying north- westerly of the southeasterly line of the parcel of land described in Final Decree of Condemnation in Case No. 100040 of the Superior Court of Orange County, a certified copy of said Decree being recorded in Book 6679, page 964 of Official Records in said office, and as corrected by Nunc Pro Tunc Order, a certified copy of which was re- corded in Book 6893, page 573 of said Official Records . That portion of Section 19, Township 6 South, Range 10 West , in the Rancho Las Bolsas in the County of Orange, as shown on a map recorded in Book 51, page 14 of Miscellaneous Maps in the office of the County Recorder of said county, described as follows : Beginning at the intersection of the center line of Brookhurst Street (formerly Wright Street) , as described in deed to the County of Orange, recorded in Book 2535, page 578 of Official Records in said office, with the northeasterly line of the 30 foot strip of land conveyed to the State of California by Final Decree of Condemnation in Case No. 26598 of Superior Court of Orange County, a certified copy of said Decree being recorded in Book 611, page 99 of said Official Records ; thence south- easterly along said northeasterly line to the easterly boundary of the Rancho Las Bolsas as shown on a map recorded in Book 2, pages 332 and 333 of Patents in the office of the County Recorder of Los Angeles County; thence along said boundary northerly to the most southerly corner of the land conveyed to A. C. Thorpe by deed recorded in Book 302 , page 69 of Deeds in said first mentioned office; thence along the south- westerly line of said land, northwesterly to 3. said center line of said Brookhurst Street ; thence along said center line southwesterly to the Point of Beginning. EXCEPTING THEREFROM that portion thereof lying northwesterly of the southeasterly line of said Brookhurst Street . ALSO EXCEPTING therefrom a strip of land 15 . 00 feet wide, the east boundary line of which is described as follows : Beginning at a point where the south line of the northeast quarter of the southeast quarter of Section 18, Township 6 South, Range 10 West , S.B.B. & M. , intersects the easterly boundary of the Rancho Las Bolsas; thence southerly along the eastern boundary of the lands of the Willow Land Company lying west of the Santa Ana River to the Pacific Ocean, as conveyed to the City of Santa Ana by deed recorded June 21, 1912 in Book 218, page 57 of Deeds, in said first men- tioned office. SECTION 2. The Planning Director of the City of Huntington Beach is hereby directed to change District Map 22 (Sectional District Map 19-6-10) and District Map 29 (Sectional District Map 24-6-11) to incorporate the zone change described in Section l hereof, and as said district maps shall have been amended, the same shall be in full force and effect and be a part of the Huntington Beach Ordinance Code. A copy of said district maps , as amended hereby, are available for inspection in the office of the City Clerk. SECTION 3. Section 9061, District Maps 22 and 29 thereof, are hereby amended by Zone Case No. 77-3 "B. " SECTION 4 . This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the pas- sage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News , a weekly newspaper of general circulation, printed and published in Huntington Beach, California.
