AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY AMENDING SECTION 9061 THEREOF TO PROVIDE
FOR CHANGE OF ZONING ON REAL PROPERTY LOCATED
ON THE SOUTH SIDE OF TALBERT AVENUE WEST OF
BEACH BOULEVARD (ZONE CHANGE NO. 77-27)
WHEREAS, pursuant to the state Planning and Zoning Law,
the Huntington Beach Planning Commission and Huntington Beach
City Council have had separate public hearings relative to Zone
Case No. 77-27 wherein both bodies have carefully considered
all information presented at said hearings, and after due con-
sideration of the findings and recommendations of the Planning
Commission and all evidence presented to said City Council, the
City Council finds that such zone change is proper, and con-
sistent with the General Plan,
NOW, THEREFORE, the City Council of the City of Huntington
Beach does ordain as follows :
SECTION 1. The following described real property located
on the south side of Talbert Avenue, approximately five hundred
(500) feet west of Beach Boulevard, is hereby changed from
Ml-A, "Restricted Manufacturing District" and C4, "Highway
Commercial District" to (Q) Rl-PD, "Qualified Classification,
Low Density Residential District--Planned Development : "
Lots 1-25, Block E, Tract 172; Lots 1-150,
Block A, Tract 172; Lots 1-150, Block B,
Tract 172; Lots 1-3 , 7-9 , 13-15, 19-21,
25-27, 31-33, 37-39, "43-45, 49-51, 55-57,
61-63, 67-69, 73-75, 79-82, 85-88, 91-94,
97-100, 103-106, 109-112, 115-118, 121-124,
127-130, 133-136, 139-142, and 145-148 of
Block C, Tract 172, City of Huntington Beach,
County of Orange, State of California.
subject to the following; conditions :

1.
(a) There shall be a minimum forty-five (45) foot setback
consisting of common open space, measured from the west property
line of the 11.2 acre site if such property line abuts indus-
trially zoned property at the time of development approval.
(b) Review and approval of any development proposal shall
be for the entire 11. 2 acre site.
(c) Access to the site shall be limited to two (2) points
of ingress and egress , and shall be subject to approval by the
Planning Department and Department of Public Works .
SECTION 2 . The Planning Director of the City of Huntington
Beach is hereby directed to change District Map 39 (Sectional
.District Map 35-5-11) to incorporate the zone change described in
Section 1 hereof, and as said district map shall have been
amended, the same shall be in full force and effect and be a
part of the Huntington Beach Ordinance Code. A copy of said
district map, as amended hereby, is available for inspection
in the office of the City Clerk.
SECTION 3 . Section 9061, District Map 39 thereof, is hereby
amended by Zone Case No. 77-27.
SECTION 4. This ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the pas-
sage of this ordinance and cause same to be published within
fifteen days after adoption in the Huntington Beach News, a
weekly newspaper of general circulation, printed and published
in Huntington Beach, California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 19th
day of- December , 1977.

City Council of the said City, do hereby certify that the whole number
of members of the City Council of the City of Huntington Beach is seven
that the foregoing ordinance was read to said City Council at a regular
adjourned meeting thereof held on the 12th day of December
1977 , and was again read to said City Council at a regular
meeting thereof held on the 19th day of December 1977 and
was passed and adopted by the affirmative vote of more than a majority of
all the members of said City Council.
