ORDINANCE NO. 2300
AN URGENCY ORDINANCE OF THE CITY OF HUNTINGTON
BEACH AMENDING SECTION 5. 32.040 OF THE HUNTINGTON
BEACH MUNICIPAL CODE POSTPONING DELINQUENCY DATE
BASE ANNUAL FEES TO SEPTEMBER 1, 1978
The City Council of the City of Huntington Beach does
ordain as follows :
SECTION 1. The Huntington Beach Municipal Code is hereby
amended by amending Section 5. 32 .040 heretofore recently amended
by urgency Ordinance No. 2298, to read as follows :
5. 32. 040 Base annual fee--Due when. The base annual
fee required by this amendment to this chapter shall be due and
payable on or before July 1 of each fiscal year. Such base an-
nual fee shall be delinquent on the day following such due date ;
provided, however, that for the period beginning July 1, 1978,
every
person required by this chapter to pay such base annual
fee shall be granted a sixty (60) day grace period in which to
meet the requirements imposed by this chapter, and no penalty
shall be exacted therefor for the period up to and including
September 1, 1978 .
SECTION 2. The Council finds that it is necessary for
this ordinance to be adopted as an emergency measure, and such
ordinance shall take effect upon its adoption. The reason for
its urgency are as follows :
1. Ordinance No. 2298 was an urgency ordinance hereto-
fore adopted amending Sections 5 . 32.020 , 5. 32 .030 and 5. 32. 040
of the Huntington Beach Municipal Code and amending the title
of Chapter 5. 32 , all pertaining to natural resources production
fees . Said ordinance and the within amendment are necessary so
that the police, fire and other public safety services of the
city may be maintained at not less than current levels of service.
2 . The total of the funds which will be available to the
city in the years following fiscal year 1977-1978 for all of
the necessary services to be provided the citizens of the city

will be inadequate to provide for the cost of such services
without the imposition of such additional taxes .
3. The addition to the California State Constitution of
Article , XIII A severely limits the city's prerogative to provide
needed and necessary revenues by the way of additional tax rev-
enues after July 1, 1978, and therefore, it is of urgent ne-
cessity that the tax increase imposed by Ordinance No. 2298 be
implemented. However, postponement of the delinquency date of
the base annual fees from August 1, 1978 until September 1, 1978
is necessary to provide for the orderly collection and administra-
tion of said taxes.
SECTION 3 . The City Clerk shall certify to the passage of
this ordinance and shall cause same to be published within fifteen
days of its passage in the Huntington Beach News , a newspaper of
general circulation, printed and published in the County of Orange.
