AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH MUNICIPAL CODE
BY ADDING THERETO SECTION 1. 16. 0$0 PERTAINING
TO AUTHORITY TO ISSUE CITATIONS
The City Council of the City of Huntington Beach does
ordain as follows :
SECTION 1. The Huntington Beach Municipal Code is hereby
amended by adding Section 1. 16. 080 thereto to read as follows :
1.16. 080 Authority to issue citations. The following
designated public officers and employees have the duty to
enforce provisions of this code as hereinafter specified and
are 'authorized to arrest persons without a warrant whenever
they have reasonable cause to believe that the person to be
arrested has committed a violation of said provisions in their
j presence. In any case in which a person is arrested pursuant
to this section and the person arrested does not demand to be
taken before a magistrate, the officer or employee making the
arrest shall prepare a written notice to appear and release
the person on his promise to appear as prescribed by Chapter
5C, Title III of Part 2 of the Penal Code of the State of
California, commencing with Section 853. 6. The public officers
so empowered are :
The director of planning, assistant director of
planning, chief land use technician, and the land use techni-
cians of the city of Huntington Beach, all of whom are empowered
as specified above to enforce the provisions of Division 9 of
the Huntington Beach Ordinance Code and Chapters 8. 20, 8. 36,
8. 44, and 8. 48 of the Huntington Beach Municipal Code.
SECTION 2. The adoption of this ordinance shall not in
any manner affect the prosecution for violation of ordinances ,
which violations were committed prior to the effective date
hereof, nor shall it be construed as affecting any of the pro-
visions of such ordinance relating to the collection of any
license or penalty or to the penal provisions applicable to
any violation thereof, nor to affect the validity of any bond
or cash deposit in lieu thereof, required to be posted, filed,
or deposited pursuant to any ordinance and all rights and ob-
ligations thereunder appertaining shall continue in full force
and effect .

SECTION 3. The City Clerk shall certify to the passage
of this ordinance and shall cause same to be published within
fifteen days of its passage in the Huntington Beach News , a
newspaper of general circulation, printed and published in
Huntington Beach, California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the
day of , 1978.

that the foregoing ordinance was read to said City Council at a regular
meeting thereof held on the 18th day of September
19 78 , and was again read to said City Council at a regular
meeting thereof held on the day of 19 and
was passed and adopted by the affirmative vote of more than a majority of
all the members of said City Council.
