HomeMy WebLinkAboutOrdinance #2332 ORDINANCE NO. 2332 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING A DEPARTMENT OF HARBORS, BEACHES, RECREATION, AND PARKS The City Council of the City of Huntington Beach does ordain as follows: SECTION I. Chapters 2.44 and 2.60 of the Huntington Beach Municipal Code are hereby repealed. SECTION 2. There is hereby added a new chapter to the Huntington Beach Municipal Code, to be numbered Chapter 2.30, which said chapter reads as follows: Chapter 2.30. Harbors, Beaches, Recreation and Parks. 2.30.010. Established. There is hereby established a department of Harbors, $eaches, Recreation, and Parks. 2.30.020. Obiectives. The objectives of the department shall be as follows: (a) To establish, facilitate, and maintain ample and sufficient safety services for the Harbors and Beaches owned and controlled by the City. (b) To operate and maintain the municipal parking lot, and other beach and harbor facilities of the City. (c) To encourage, foster, facilitate, establish and maintain a systematized recreation, park acquisition and development, and human services program as directed by the City Council. (d) To assist advisory boards, commissions, and committees including, but not limited to, the Recreation and Parks Commission, the Human Resources Council and the Council on Aging. (e) To cooperate with other governmental agencies and civic groups in the advancement of sound recreational and park planning under the direction of the City Council. (f) To be responsible for human services, including limited direct service delivery as well as the enhancement of communication, cooperation, and coordination among agencies, organizations, and those individuals providing services to the residents of the City, such services to be offered on any of the properties owned or controlled by the City or on any other properties with the consent of the owners and the authorities thereof. RCS:sh I. 11/16/78 2.30.030 Director - Powers and duties. The director of Harbors, Beaches, Recreation and Parks shall be appointed by the City Administrator with the approval of the City Council. The director shall have the following powers and duties: (a) Plans, organizes and directs programs and activities in Harbors, Beaches, Recreation and Parks. (b) Directs and coordinates all activities and phases of operations within the department. (c) Advises on acquisition, design and construction of recreational, beaches and park facilities. (d) Insures recreation, beaches, harbor and parks needs are met and maintained within established framework, and executes policy rules and regulations as established by the City Council. (e) Investigates and authorizes purchase of materials and equipment necessary to implement and operate programs. (f) Determines department policies and procedures. (g) Communicates program plans and activities to various City, inter-city and community groups. (h) Prepares and administers departmental budget. (i) Formulates and administers lease agreements. (j) Serves as secretary to the Recreation and Parks Commission or appoints deputy to so serve. (k) Perform such other duties and have such other powers as the City Council may establish hereafter by resolution. 2.30.040 Appointment of subordinates. The director, with the approval of the City Administrator, shall appoint all other officers, assistants, deputies, and employees of the Harbors, Beaches, Recreation and Parks Department. 2.30.050 Fees and charges. The department has authority to charge reasonable fees for use of city buildings, property, and facilities, and for participation in recreational activities to help defray public expense, subject to approval of the City Council. 2.30.060 Acceptance of gifts. The department may accept all gifts, devises, legacies, or bequests from any source, public or private, in the name of the city subject to the approval of the City Council. All monies so obtained by the department shall be deposited by the director or his duly authorized subordinate in the general fund of the Treasury of the city or in any special fund the City Council may designate. 2.30.070 Annual budget. The City Council shall annually establish a Harbors, Beaches, Recreation and Parks budget. 2. 2.30.080 Terms. Wherever the terms "Harbors and Beaches Department" and "Recreation, Parks and Human Services Department" are used in this code, or in any resolution adopted by the City Council, they shall be deemed to mean and read "Harbors, Beaches, Recreation and Parks Department." Wherever the terms "Director of Harbors and Beaches" and "Director of Recreation, Parks and Human Services" are used in this code, they shall be deemed to mean and read "Director of Harbors, Beaches, Recreation and Parks." SECTION 3. If any provision of this ordinance is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the other provisions or remainder of this ordinance or any prior ordinance and if this ordinance or any provision hereof is found invalid or unconstitutional, this ordinance will not have the effect of repealing any portion of any prior ordinance amended by such invalid or unconstitutional provision. SECTION 4. Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provision of such ordinances relating to the collection of any fees, taxes, interest or penalty or the penal provisions applicable to any violation thereof, and all rights and obligations thereunder appertaining shall continue in full force and effect. SECTION 5. The City Clerk shall certify to the passage of this ordinance and shall cause same to be published within fifteen (15) days of its passage in the Huntington Beach Independent, a newspaper of general circulation printed and published in the County of Orange.
