HomeMy WebLinkAboutOrdinance #2355 ORDINANCE N0. 2355 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR CHANGE OF ZONING FROM HIGHWAY COMMERCIAL DISTRICT TO QUALIFIED MEDIUM DENSITY RESIDEN- TIAL DISTRICT ON REAL PROPERTY LOCATED ON NORTH SIDE OF PACIFIC COAST HIGHWAY, WEST OF ANDERSON STREET (ZONE CASE NO. 78-19) WHEREAS, pursuant to the state Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Case No. 78-19 wherein both bodies have carefully considered all information presented at said hearings , and after due con- sideration of the findings and recommendations of the Planning Commission and all evidence presented to said City Council, the City Council finds that such zone change is proper, and consis- tent with the general plan, g p , NOW, THEREFORE, the City Council of the City of Huntington I Beach does ordain as follows : SECTION 1. The following described real property located on the north side of Pacific Coast Highway approximately fifteen hundred (1500) feet west of Anderson Street, is hereby changed from C4, "Highway Commercial District" to (Q) R2, "Medium Density Residential District" subject to the following conditions : (a) All code requirements with respect to access thereto shall be met; or (b) A plan for access satisfactory to the Huntington Beach Fire Department shall be developed. That portion of fractional Section 24, Township 5 South, Range 12 West of the San Bernardino Meridian, according to the official plat of said land, filed in the District Land Office , being a portion of Parcel /ahb 1 . 2/9/78 174-2 of Case No. * 3436-WM Civil in the District Court of the United States, in and for the Southern District of Southern California, together with a portion of State Tide Land, location No. 141, as described in Decree of Confirmation No. A-726, correcting the description in the original Patent, a copy of which was recorded July 2, 1929 in Book 287, page 231 of the Official Records of Orange County, said real property located in the city of Huntington Beach, county of Orange, state of California, and shown as Parcel 2 on a map in Book 44, page 24 of Parcel Maps , records of Orange County, California. SECTION 2. The Planning Director of the City of Huntington Beach is hereby directed to change District Map 28 (Sectional District Map 24-5-12) to incorporate the zone change described in Section 1 hereof, and as said district map shall have been amended, the same shall be in full force and effect and be a part of the Huntington Beach Ordinance Code. A copy of said district map, as amended hereby, is available for inspection in the office of the City Clerk. SECTION 3. Section 9061, District Map 28 thereof, is hereby amended by Zone Case No. 78-19. SECTION 4. This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the pas- sage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach Independent, a newspaper of general circulation.
