HomeMy WebLinkAboutOrdinance #2361 ORDINANCE N0. 2361 AN URGENCY ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH MUNICIPAL CODE BY AMENDING SECTION 5. 24 . 050 PERTAINING TO PERMITS FOR BATHHOUSES AND MASSAGE PARLORS The City Council of the City of Huntington Beach does ordain as follows: SECTION 1. The Huntington Beach Municipal Code is hereby amended by amending Section 5. 24 .050 to read as follows : 5.24. 050 Permit--Issuance. (a) The chief of police shall issue such permit to such applicant if it shall reasonably ap- pear to him, after investigation, that the applicant possesses good moral character and is a proper person to conduct or work at such business . The chief of police shall issue such permit to the applicant or deny such application within sixty (60) days from the date thereof. I (b) After the effective date of this subsection, no new massage parlor permits shall be issued for six ( 6) months ; however, an existing permit may be transferred to a new owner or operator in connection with the transfer of substantially all of the assets of an existing massage parlor business. Every new owner/applicant shall be required to meet the permit requirements of this section. SECTION 2. This emergency ordinance is further necessary for the public peace, health or safety in that there are cur- rently pending numerous applications for massage parlor opera- tions . The existing massage parlor ordinance provides for timely processing of permits within sixty ( 60) days and will not prevent issuance of such permits . In accordance with the City Council's determination that numerous massage parlors are a danger to the public peace, health and safety, it is vital that such businesses be limited in number. SECTION 3. This ordinance shall take effect upon adop- tion. The City Clerk shall certify to the passage of this GH:WS:sh 1 . 3/12/79 ordinance and cause same to be published within fifteen (15) days after adoption in the Huntington Beach Independent, a newspaper of general circulation.
