HomeMy WebLinkAboutOrdinance #2368 ORDINANCE NO. 2368 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION go61 THEREOF TO PROVIDE FOR CHANGE OF ZONING FROM LIGHT MANUFACTURING AND LIGHT MANUFACTURING COMBINED WITH OIL PRO- DUCTION DISTRICT TO MEDIUM DENSITY PLANNED RESIDENTIAL DEVELOPMENT DISTRICT ON REAL PROPERTY LOCATED ON THE SOUTH SIDE OF GARFIELD AVENUE EAST OF BEACH BOULEVARD (ZONE CASE NO. 79-5) WHEREAS, pursuant to the state Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Case No. 79-5 wherein both bodies have carefully considered all information presented at said hearings, and after due con- sideration of the findings and recommendations of the Planning Commission and all evidence presented to said City Council, the City Council finds that such zone change is proper, and consis- tent with the general plan, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The following described real property located on the south side of Garfield Avenue approximately 250 feet east of Beach Boulevard is hereby changed from Ml, "Light Manu- facturing District" and Ml-O, "Light Manufacturing combined with oil production District" to R2-PD, "Medium Density Planned Residential Development District :" PARCEL A: Parcel 1, in the City of Huntington Beach, County of Orange, .State of California, as shown on a map filed in book 24 , page 50 of Parcel Maps , in the office of the county recorder of said county. EXCEPTING from a portion of said land all minerals , petroleum, asphaltum, brea, oil and gas and other hydrocarbons , in, upon or under, or that may be produced from said land, as conveyed to Cajo Oil Company, a co-partnership, by deed recorded in JGps 3/14/79 1 . book 2317, page 595, Official Records. By quitclaim deed recorded in book 8051, page 141, Official Records , Cajo Oil Company, a co-partnership, quitclaimed any and all right to enter upon or use the surface and/or sub- surface to a depth of 500 feet measured from the present surface of the ground. EXCEPTING from the remainder all oil, gas , petroleum and other mineral or hydrocarbon substances in and under or which may be pro- duced from said land, together with the right to use that portion only of said land which underlies a plane parallel to and 500 feet below the present surface of said land, for the purpose of prospecting for, developing and/or extracting said oil, gas , petroleum and other mineral or hydrocarbon substances from said land by means of wells drilled into said sub- surface of said land from drill sites located on other lands , it being expressly understood and agreed that said Carl R. Steverson and others their heirs and assigns, shall have no right to enter upon the surface of said land, or to use said land or any portion thereof to said depth of 500 feet, for any purpose whatsoever, as reserved by Carl R. Steverson and others, by deed to the Southern California Edison Company, a corporation, recorded September 19, 1966, in book 8051, pages 131 and 137, Official Records. PARCEL B : That portion of the Northwest quarter of the Northwest quarter of Section 1, Township 6 South, Range 11 West, in the Rancho Las Bolsas , City of Huntington Beach, County of Orange, State of California, as shown on a Map recorded in book 51, page 14 of Miscellaneous Maps , in the office of the County Recorder of said county. The West 55 feet of the East 215 feet and the West 110 feet of the East 160 feet of the follow- ing: Beginning at a point in the Westerly line of said Section 1, 2, 466 feet Northerly from the South- west corner of the Northwest quarter of said Section 1; thence East 530 feet thence Northerly parallel with the Westerly line of said Section, to the Northerly line of said Section; thence Westerly along said Northerly line 530 feet; thence Southerly to the point of beginning. 2. PARCEL C : That portion of the West half of the North- west quarter of Section 1, Township 6 South, Range 11 West , in the Rancho Las Bolsas , City of Huntington Beach, County of Orange, State of California, as shown on a map recorded in book 51, page 14 of Miscellaneous Maps in the office of the County Recorder of said County, described as follows : Beginning at the intersection of the center line of Garfield Avenue, 60 feet wide, with the Westerly line of that portion of said West half of the Northwest quarter conveyed to Ana- heim Sugar Company by deed recorded in book 450, page 240 of Official Records of Orange County, California; thence Southerly along said Westerly line to a point in a line that is parallel with and 660. 00 feet Southerly, measured at right angles , from said center line of Garfield Avenue; thence Easterly along said parallel line to a point in a line that is parallel with and 330. 00 feet, Easterly, measured at right angles , from said Westerly line; thence Northerly, along said last men- tioned parallel line, 660. 00 feet to the inter- section thereof with said center line of Garfield Avenue; thence Westerly along said center line 330. 00 feet to the point -of beginning. EXCEPTING THEREFROM all oil, gas, petroleum and other mineral or hydrocarbon substances in, under or which may be produced from said land together with and including as incident thereto the right to use that portion only of said land which under- lies a plane parallel to and 500 feet below the present surface of said land for the purpose of prospecting for, developing and/or extracting said oil, gas , petroleum and other mineral or hydro- carbon substances from said land by means of wells drilled into said subsurface or said land from drill sites located on other land and shall have no right to enter upon the surface of said land or to use said land or any portion thereof to said depth of 500 feet for any purpose whatsoever, as reserved in the deeds from Dorothy Thayer Peck, Charles H. Thatcher and Title Insurance and Trust Company as Trustees, recorded June 12th, 1958 and from Dorothy T. Peck and Charles H. Thatcher as Executors of the Will of Aldrich R. Peck, deceased, recorded June 12th, 1958 in book 4313, pages 23 and 37 of Official Records. 3. SECTION 2. The Planning Director of the City of Huntington Beach is hereby directed to change District Map 1 (Sectional District Map 1-6-11 ) to incorporate the zone change described in Section 1 hereof, and as said district map shall have been amended, the same shall be in full force and effect and be a part of the Huntington Beach Ordinance Code. A copy of said district map, as amended hereby, is available for inspection in the office of the City Clerk. SECTION 3. Section 9061, District Map 1 thereof, is hereby amended by Zone Case No. 79-5. SECTION 4. This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the pas- sage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach Independent , a newspaper of general circulation.
