AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY REPEALING SECTIONS 9001 THROUGH 9007 ; _AND
ADDING THERETO NEW SECTIONS 9001 THROUGH 9007
ESTABLISHING A PLANNING COMMISSION AND REGULA-
TIONS THERETO
The City Council of the City of Huntington Beach does
ordain as follows :
SECTION 1 : Sections 9001 through 9007 of the Huntington
Beach Ordinance Code are hereby repealed.
SECTION 2 : The Huntington Beach Ordinance Code is hereby
amended by adding thereto Sections 9001 through 9007 to read
as follows :
9001 Commission established. There is hereby established
a Planning Commission in and for the City of Huntington Beach
which shall be known as the Planning Commission of the City of
Huntington Beach. The authority to create a Planning Commission
is derived from the Huntington Beach City Charter Section 405 .
9002 Duties . The duties of the Planning Commission shall
be as provided in the California Government Code , Title 7 , as
may be amended, and as provided by ordinance of the City of
Huntington Beach.
In addition to powers and duties specified in the Govern-
ment Code, the Planning Commission shall have the power and be
required to :
(a) Recommend to the City Council after a public hearing
thereon, the adoption, amendment or repeal of a Master or General
Plan, or any part thereof, for guidance in the physical develop-
ment of the City .
(b ) Exercise such functions with respect to land subdivi-
sions as shall be provided by ordinance not inconsistent with
the provisions of the Charter.
(c) Exercise such functions with respect to zoning, build-
ing, land use, precise plans , specific plans , and related matters
which may be presecribed by ordinance not inconsistent with the
provisions of the Charter .

(d) Perform such other functions not inconsistent with
the Charter as may be delegated to it by the City Council .
9002 . 1 Records of Commission. Accurate and permanent
records of the acts of the Commission shall be kept , and such
records shall have the same status as records of other admini-
strative departments of the City.
9003 Members . The Planning Commission shall consist of
seven (7) members who shall be residents of the City and shall
not be officers or employees of the City.
9003 . 1 Members of the Planning Commission shall be
appointed by a majority of the City Council.
9003 . 2 Members of the Planning Commission shall be
appointed for four (4) years or such other term as the City
Council may specify in making such appointment .
9003 . 3 Any member of the Planning Commission may be
removed from office by a majority vote of the Council .
9004 Bylaws . The Planning Commission shall adopt such
bylaws and rules as it deems necessary to provide for its
officers and their method of selection, time and place of
meetings and for such other matters relative to its work and
administration of its duties which are not otherwise pro-
vided for by statute or ordinance .
9005 Advisors . The Planning Commission may request attend-
ance at its meetings of any officer or employee of the City to
assist the Commission in its deliberations in an advisory capa-
city but who shall not have the authority to vote upon any
matter being considered by the Commission.
9006 Assistance for Commission. The Commission may make
such investigations , employ such city help ; secure such advice ,
and have prepared such plans and reports as it may deem neces-
sary -to perform its duties and functions .
9007 Compensation. Members of the Planning Commission
may receive compensation for their service . Said compensation
shall be set by resolution of the City Council .

SECTION 3 . The provisions of this ordinance insofar as
they are substantially the same as existing provisions of the
Huntington Beach Ordinance Code relating to the same subject
matter shall be construed as restatements and continuations
and not as new enactments .
SECTION 4 . This ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the passage
of this ordinance and cause same to be published within fifteen
days after adoption in the Huntington Beach Independent , a news-
paper of general circulation.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 18th
day of June 1979 .

meeting thereof held on the 18th day of June 19 79 and
was passed and adopted by the affirmative vote of more than a majority of
all the members of said City Council.
