HomeMy WebLinkAboutOrdinance #2411 ORDINANCE N0 . 2411 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY REPEALING SECTIONS 9103 .4. 1 , 9163 .4.1, 9204 .2 , 9233 .4 .2 , 9603.4 .1 , 9604.2 AND 9775 .3, AMENDING SECTIONS 9156.4(c) AND 9356 .4( c) , AND ADDING NEW SECTIONS 9103.4.1, 9156.4. 1, 9163 .4 .1, 9204 .2 , 9233.4 .2 , 9356.4 .1 , 9603.4 .1 AND 9775.3, ALL PERTAINING TO STREET INTERSECTION VISIBILITY IN THE OLDTOWN, R1_, R2, R3, R41 TOWNLOT, RA DISTRICTS AND GENERAL YARD PROVISIONS n The City Council of the City of Huntington Beach does ordain as follows: SECTION 1 . Sections 9103.4 .1 , 9163.4 .1 , 9204.2 , 9233.4.2 , 9603 .4. 1 , 9604 .2 and 9775.3 of the Huntington Beach Ordinance Code are hereby repealed . SECTION 2 . The Huntington Beach Ordinance Code is hereby amended by amending Sections 9156.4(c) and 9356 .4(c) to read as follows: 9156 .4( c) Fences , Walls and Hedges . Fences , walls and hedges which do not exceed six feet in height may be lo- cated on any portion of the site except with the front and rear yard areas subject to the following limitations: (1 ) Corner Site. Fences or walls which do not exceed six (6 ) feet in height may be erected in the exterior side yard of a corner site provided they are not closer than twenty-five (25 ) feet to the front property line. (2) Corner Site Abuttin an Alley . Within a triangular area formed by measuring ten 10 feet along an alley and ex- terior side site lines , there shall be no structure , fence, wall , hedge, or landscaping erected or maintained over forty-two (42) inches in height. (3) Height Measurement of Fence or Wall . The height of a fence may be measured from either side of the fence, provided that where a retaining wall is combined with a fence , no portion of the retaining wall will be measured in meeting fence require- JG: ahb 12/7/79 1• ments . Any combination of retaining wall and fence over eight (8) feet high must be built with a variation in design or ma- terial between retaining portion and fence . This section shall not prohibit placement of trash enclosures within the rear yard areas . 9356 .4( c) Fences , Walls and Hedges . Fences , walls and hedges which do not exceed six ( feet in height may be located on any portion of the site except within the front and rear yard areas subject to the following limitations: (1 ) Corner Site. Fences or walls which do not exceed six (6) feet in height may be erected in the exterior side yard of a corner site provided they are not closer than twenty-five (25) feet to the front property line. The Huntington Beach Ordinance Code is hereby amended by adding thereto Sections 9103 .4.1, 9156 .4.1, 9163 .4.15 9204 .25 9233 .4 .25 9356 .4 .15 9603 .4 .1 and 9775.3 to read as follows: 9103 .4.1 . STREET INTERSECTION VISIBILITY. On corner lots , in all districts , no fence, hedge, wall , sign, structure , mound of earth, landscaping, or other visual obstruction between forty-two (42) inches and seven (7) feet in height above the nearest street curb elevation, shall be erected , placed, planted or allowed to grow within the triangular area formed by the in- tersecting exterior property lines , or their prolongation, and a diagonal intersecting the twenty-five (25) foot property lines , when measured along such exterior property lines from the point where such property lines intersect. Trees which are trimmed free of branches or foliage to a height on the trunk not less than seven (7) feet above the nearest street curb elevation are exempt from the above prohibition. 9156 .4 .1 . STREET INTERSECTION VISIBILITY. On corner lots, 2. in all districts, no fence, hedge, wall , sign, structure, mound of earth, landscaping, or other visual obstruction between forty-two (42) inches and seven (7) feet in height above the nearest street curb elevation, shall be erected, placed, planted or allowed to grow within the triangular area formed by the in- tersecting exterior property lines , or their prolongation, and a diagonal intersecting the twenty-five (25) foot property lines , when measured along such exterior property lines from the point where such property lines intersect. Trees which are trimmed free of branches or foliage to a height on the trunk not less than seven (7) feet above the nearest street curb elevation are exempt from the above prohibition. 9163 .4.1 . On corner lots , in all districts , no fence, hedge, wall , sign, structure, mound of earth, landscaping, or other visual obstruction between forty- two (42) inches and seven (7) feet in height above the nearest street curb elevation, shall be erected, placed, planted or allowed to grow within the triangular area formed by the intersecting ex- terior property lines , or their prolongation, and a diagonal inter- secting the twenty-five (25 ) foot property lines , when measured along such exterior property lines from the point where such property lines intersect . Trees which are trimmed free of branches or foliage to a height on the trunk not less than seven (7) feet above the nearest street curb elevation are ex- empt from the above prohibition. SECTION 4 . This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach Independent, a news- 4. paper of general circulation .
