HomeMy WebLinkAboutOrdinance #2422 ORDINANCE N0 . 2422 AN URGENCY ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTO N BEACH MUNICIPAL CODE BY AMENDING SUBSECTION (p) OF SECTION 10.12 .050, AND ADDING NEW SUBSECTION ( s) TO SECTION 10 .12 .030, REDUCING THE PRIMA FACIE SPEED LIMIT ACROSS WARNER AVENUE BRIDGE The City Council of the City of Huntington Beach does ordain as follows: SECTION 1. The Huntington Beach Municipal Code is hereby amended by amending Section 10 .12 .050 to read as follows: 10 .12.050 Forty-five m.p.h. prima facie speed limit. Upon the basis of an engineering and traffic survey of the portions of streets ,hereinafter set forth, the city council determines and declares that the prima facie speed limit of sixty-five (65 ) miles per hour is more than is reasonable or safe; that a speed limit of forty-five ( 45 ) miles per hour is the most appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and that the prima facie limit of speed on portions of the following streets shall be and is forty-five (45) miles per hour: (a) Adams Avenue between Beach Boulevard and east city limits; (b) Bolsa Avenue between Springdale and Goldenwest Streets; ( c) Bolsa Chica Street between Garfield and Hamilton Avenues; (d) Brookhurst Street between Garfield and Hamilton Avenues; ( e) Bushard Street between Garfield Avenue and Brookhurst Street ; (f) Edinger Avenue between Beach Boulevard and east city limits; (g) Ellis Avenue between Edwards and Goldenwest Streets ; (h) Garfield Avenue between Newland and Ward Streets ; (i) Garfield Avenue between Edwards and Goldenwst Streets ; ( j) Gothard Street between Edinger and Warner Avenues; (k) Graham Street between Bolsa and Edinger Avenues; ( 1) Magnolia Street between San Diego Freeway and Warner Avenue; and between Garfield Avenue and Pacific Coast Highway; (m) McFadden Avenue between Graham and Goldenwest Streets; (n) Springdale Street between Edinger Avenue and north /ahb 3/7/80 1 . city limits; (o) Ward Street between Yorktown and Garfield Avenues; (p) Warner Avenue between Magnolia Street and Sceptre Lane. SECTION 2. The Huntington Beach Municipal Code is hereby amended by adding subsection (s) to Section 10 .12.030 to read as follows: 10 .12 .030 Thirty-five m.p.h. prima facie speed. Upon the basis of an engineering and traffic survey of the portions of the streets hereinafter set forth , the city council determines and declares that a speed greater than the prima facie limit of twenty-five ( 25) miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon said streets; that a prima facie speed limit of thirty-five ( 35 ) miles per hour is the most appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and that the prima facie limit of speed on portions of the following streets shall be and is thirty-five (35) miles per hour: (a) Clay Avenue between Main and Delaware Streets; (b) Davenport Drive between Edgewater Lane and Algonquin Street; (c) Delaware Street between Main Street and Yorktown Avenue; (d) Delaware Street between Adams and Indianapolis Avenues; (e) Edwards Street between Bolsa Avenue and north city limits; (f) Ellis Avenue between Delaware Street and Beach Boulevard; (g) Gothard Street between Warner Avenue and Main Street; (h) Graham Street between Heil and Warner Avenues; ( i) Heil Avenue between Beach Boulevard and east city limits ; ( j) Huntington Street between Atlanta Avenue and Pacific Coast Highway; (k) Lake Avenue between 17th Street and Pacific Coast Highway; (1) Main Street between Yorktown and Adams Avenues ; (m) Monterey Lane between Edinger Avenue and Saybrook Lane; (n) Palm Avenue between Goldenwest and Main Streets; (o) Rancho Road between Bolsa Chica Street and east city limits ; (p) Sher Lane between Edinger Avenue and Juliette Low Drive; (q) Yorktown Avenue between Goldenwest Street and Beach Boulevard; ( r) Seventeenth Street between Florida Street and Pacific Coast Highway; ( s) Warner Avenue between Sceptre Lane and Pacific Coast Highway. 2. SECTION 3. This is an emergency ordinance necessary for the immediate preservation of the public peace , health, safety and welfare , and shall take effect upon adoption. The City Council finds that a condition hazardous to the motoring public exists on Warner Avenue due to the partial closure of Warner Avenue bridge which has reduced the number of traffic lanes available to the motoring public across such bridge , thereby making the present speed limit of forty-five miles per hour unsafe for vehicular traffic approaching Warner Avenue bridge , but that a speed limit of thirty-five miles per hour is suf- ficient to alert motorists that such bridge is being recon- structed. SECTION 4. The City Clerk shall certify to the passage of this ordinance and shall cause same to be published within fifteen days of its passage in the Huntington Beach Independent, a news- paper of general circulation.
