AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY AMENDING SECTION 9061 THEREOF TO PROVIDE
FOR CHANGE OF ZONING FROM MEDIUM DENSITY RESI-
DENTIAL TO MEDIUM DENSITY RESIDENTIAL--PLANNED
DEVELOPMENT ON REAL PROPERTY LOCATED SOUTH OF
ATLANTA AVENUE AND EAST OF BEACH BOULEVARD
(ZONE CASE NO . 80-2)
WHEREAS , pursuant to the state Planning and Zoning Law,
the Huntington Beach Planning Commission and Huntington Beach
City Council have had separate public hearings relative to Zone
Case No. 80-2 wherein both bodies have carefully considered
all information presented at said hearings , and after due con-
sideration of the findings and recommendations of the Planning
Commission and all evidence presented to said City Council , the
City Council finds that such zone change is proper, and consis-
tent with the general plan,
NOW, THEREFORE, the City Council of the City of Huntington
Beach does ordain as follows:
SECTION 1. The following described real property, located
1314 feet south of Atlanta Avenue and east of Beach Boulevard,
is hereby changed from R2, "Medium Density Residential District"
to R2-PD, "Medium Density Residential Planned Development
District," and deleting a fifty (50) foot setback from the ulti-
mate right-of-way on Beach Boulevard:
The south 665 .5 feet of the north 1979 .59
feet of the west 544.55 feet of the north-
west quarter of Section 13 , Township 6 South,
Range 11 West in the Rancho Las Bolsas , city
of Huntington Beach, County of Orange, State
of California, as shown on a map recorded in
Book 51, page 14 of Miscellaneous Maps in the
office of the County Recorder of said county.

SECTION 2. The Development Services Director of the City
of Huntington Beach is hereby directed to change District Map 14
(Sectional District Map 13-6-11 ) to incorporate the zone change
described in Section 1 hereof, and as said district map shall have
been amended, the same shall be in full force and effect and be
a part of the Huntington Beach Ordinance Code. A copy of said dis-
trict map, as amended hereby, is available for inspection in the
office of the City Clerk.
SECTION 3. Section 9061, District Map 14 thereof, is hereby
amended by Zone Case No . 80-2.
SECTION 4. This ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the passage
of this ordinance and cause same to be published within fifteen
days after adoption in the Huntington Beach Independent, a news-
paper of general circulation .
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 21st
day of Apri 1 1980.

1. 0 SUGGESTED ACTION:
The staff recommends that the Planning Commission approve Zone
Change No. 80-2 and recommend to the City Council approval of said
zone change
2.0 GENERAL INFORMATION:
"Lone Change No. 80-2 was initiated by Development Services ,
to rezone the property located east of Beach Boulevard
and approximately 1314 feet south of the center line of Atlanta Ave.
from R-2 (Medium Density Residential) to R-2PD (Medium Density
Residential with Planned Development suffix) . The zone change
request also includes the deletion of the 50 ft. setback require-
ment on Beach Boulevard.
The subject property was rezoned from RA and C-4 to R-2 on
December 4, 1978. At that time, the "Planned Development" suffix
was inadvertently omitted from the proposed zone change. The
deletion of the. 50 ft. setback requirement on Beach Boulevard was
also overlooked and was not removed from the subject property.

3. 0 SUMMARY OF ISSUES :
Major issues of concern regarding Zone Change 80-2 are :
1. The addition of the "Planned Development" suffix to the existing
R-2 zoning.
2. The deletion of the 50 ft. setback requirement on Beach Boulevard.
4. O ENVIRONMENTAL STATUS :
Zone Change No. 80-2 is exempt from CEQA requirements , and no environ-
mental assessment is required at this time.
5 . 0 PRESENT LAND USE, ZONING AND GENERAL PLAN DESIGNATION :
The subject site is currently zoned R-2 (Medium Density Residential)
and is designated on the General Plan as Medium Density Residential .
The site is presently vacant. The property to the east of the subject
site is zoned R-2 (Medium High Density Residential) ' and is designated'
as Medium Density Residential on the General Plan. The property
located south of the subject site is zoned RA-O and is designated
on the General Plan as "Planning Reserve. " The property located
west of the subject site, and across Beach Boulevard is zoned RA
(Residential, Agriculture) and is designated on the General Plan
as Medium Density Residential. Lastly, the zoning designation for
property located north of the subject site is zoned C-4 (Highway
Commercial) and is presently designated on the General Plan as
General Commercial.
6 . 0 ANALYSIS :
On November 7, 1978, the Planning Commission approved a change of
zone on the subject property from RA (Residential-Agriculture) and
C-4 (Highway Commercial) to R-2 (Medium Density Residential) . The
zone change was initiated by the Department of Development Services
primarily to bring the existing zoning of the property into con-
formance with the General Plan. The Land Use Element of the General
Plan currently designates the subject property as Medium Density
Residential. Because of the existing General Plan Designation,
the zone change was initiated and ultimately approved by the City
Council on December 4, 1978. The City Council requested that the
"Planned Development" suffix be added to the R-2 zoning designation.
The intent of the "PD" suffix is that it shall require that the
Planned Residential Development Ordinance of the Code prevail
over the basic residential district whereto the suffix is affixed.
If the PD suffix is attached to the R-2 zoning, the property shall
be developed only as a Planned Residential Development.

Staff is also recommending removal of the 50 ft. setback requirement
on the subject property. Generally, the 50 ft. setback requirement
is added only to commercial properties abutting arterial streets and
highways. The setback is designed to add additional landscaping to the
site and promote architectural variation of structures fronting the
major streets in the City. Property zoned R-2 PD does not need a
required 50 ft. setback because of existing setback requirements
outlined in Article 936 of the Ordinance Code. Also, the Planning
Commission reviews all PRD site plans prior to approval of said
site plan.
Therefore, staff feels existing code requirements are sufficient and
the 50 ft. setback should be limited to commercial properties
located on arterial streets and highways.
7 . 0 RECOMMENDATION:
Staff recommends that the Planning Commission approve Zone Change
No. 80-2 with findings as outlined.
FINDINGS-
1. The "Planned Development" suffix is compatible with the zoning
and the surrounding land uses.
2. The addition of the "Planned Development" suffix is consistent
with the General Plan.
