HomeMy WebLinkAboutOrdinance #2426 ORDINANCE N0 . 2426 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR CHANGE OF ZONING FROM MEDIUM DENSITY RESI- DENTIAL TO QUALIFIED HIGHWAY COMMERCIAL DIS- TRICT ON REAL PROPERTY LOCATED BETWEEN WARNER AVENUE AND PEARCE STREET ON BOLSA CHICA STREET ( ZONE CASE NO . 80-1 ) WHEREAS , pursuant to the state Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Case No. 80-1 wherein both bodies have carefully considered all information presented at said hearings, and after due con- sideration of the findings and recommendations of the Planning Commission and all evidence presented to said City Council , the City Council finds that such zone change is proper, and consis- tent with the general plan, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows: SECTION 1. The following described real property, located between Warner Avenue and Pearce Street on Bolsa Chica Street , is hereby changed from R2, "Medium Density Residential District" to (Q) C4, "Highway Commercial District: " Lot 1 in Block 5 of Tract 86 , except the north 396 feet thereof and the south 132 feet thereof, in the city of Huntington Beach, County of Orange , State of California as per map recorded in Book 10, pages 35 and 36 of Miscellaneous Maps in the office of the County Recorder of said county. subject to the following conditions: (a) A fifty (50 ) foot front yard setback shall be estab- lished from the ultimate street right-of-way. /ahb 2/27/80 1 . (b) Upon approval of this zone case, the applicant shall file a parcel map with the city to combine the subject site with the one-acre parcel to the south. The newly-created parcel shall be developed as one integrated project . SECTION 2. The Development Services Director of the City of Huntington Beach is hereby directed to change District Map 24 (Sectional District Map 21-5-11 ) to incorporate the zone change described in Section 1 hereof, and as said district map shall have been amended, the same shall be in full force and effect and be a part of the Huntington Beach Ordinance Code. A copy of said district map, as amended hereby, is available for inspection in the office of the City Clerk. SECTION 3. Section 90611, District Map 24 thereof, is hereby amended by Zone Case No . 80-1. SECTION 4. This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach Independent, a news- paper of general circulation.
