HomeMy WebLinkAboutOrdinance #2441 ORDINANCE NO. 2441 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING CERTAIN SECTIONS PERTAINING TO ADMINISTRATIVE FEES The City Council of the City of Huntington Beach does ordain as follows: SECTION 1. The Huntington Beach Ordinance Code is hereby amended by amending sections 9760. 44 , 9813. 2 , 9815. 1. 4 , 9815. 4. 4 , 9841. 2 , 9842. 4 , 9864, 9883 , 9891. 2, 9892. 4. 1 , 9951 and 9984 to read as follows: 9760. 44. EXCEPTIONS. The Planning Commission may grant a special sign permit providing for relief from the strict applica- tion of provisions of Article 976 , subject to finding by the Planning Commission that the following conditions exist : 1. (a) Strict compliance with Article 976 will result in a substantial economic hardship to the applicant; and (b) The proposed or existing sign would not adversely affect other signs in the area; and ( c) The proposed or existing sign will not be detri- mental to the property located in the vicinity of such sign; and (d) The proposed or existing sign does not obstruct pedestrian or vehicular traffic vision. 2. Application Fee. Application for a special sign per- mit shall be filed with the Development Services Department and accompanied by a fee set by resolution of the City Council. 3. Effective Date. Special sign permits shall become ef- fective ten ( 10) days after approval by the Planning Commission , provided further that if an appeal is taken or a challenge is issued by the City Council said permit shall not become effective until the final decision of the City Council. 4. Sections 9842 through 9842. 6. 2 of Article 984 shall be JG: ahb 1. 6/17/80 applicable to special sign permits. 9813. 2 FILING FEES. At the time an application is filed , the applicant shall pay a fee set by resolution of the City Council. 9815.1 .4. FILING FEE. Accompanying any appeal shall be a filing fee set by resolution of the City Council. 9815. 4. 4. FILING FEE. Accompanying any appeal shall be a filing fee set by resolution of the City Council. 9841. 2. FILING FEE. At the time the application is filed the applicant shall pay a fee set by resolution of the City Council. 9842. 4. FILING FEE. Accompanying any appeal shall be a filing fee set by resolution of the City Council. 9864. FILING FEE. At the time such petition is filed , a fee for a conditional exception and for a zone change shall be collected for the use and benefit of the city and shall be deposited in its general fund. Such fees shall be set by reso- lution of the City Council. 9883. NOTICE. The City Clerk shall give notice of any such appeal to all property owners within 300 feet of any prop- erty on which an appeal to the City Council has been filed. To cover the expenses of such notice , a fee , set by resolution of the City Council , shall be paid by the applicant. This notice fee must be paid at the time notice of appeal is filed. Nothing in this section shall be construed to mean that a filing fee is necessary if the appeal is made by a member of the City Council. 9891. 2. FILING FEE. At the time the application is filed , the applicant shall pay a fee set by resolution of the City Council. 9892. 4. 1. FILING FEE. Accompanying any appeal shall be a filing fee set by resolution of the City Council. 9951. APPEAL FEE. At the time any appeal is filed pursuant to this chapter, a fee set by resolution of the City Council shall be paid by the appellant to the city to cover all costs. 9984. FEES. Petitions to revert property to acreage shall be accomplished by a fee paid to the city, as set by resolution of the City Council. If the proceedings are initiated pursuant to section 9993 , the person or persons who requested the City 2. Council to initiate the proceedings shall pay a fee set by reso- lution of the City Council . Fees are not refundable. SECTION 2. This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach Independent , a news- paper of general circulation.
