HomeMy WebLinkAboutOrdinance #2459 ORDINANCE NO. 2459 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR CHANGE OF ZONING FROM RESTRICTED MANUFAC- TURING TO RESTRICTED MANUFACTURING-MULTISTORY DISTRICT ON REAL PROPERTY LOCATED ON THE NORTH- WEST CORNER OF BOLSA AVENUE AND SPRINGDALE STREET (ZONE CASE NO. 80-14 ) WHEREAS, pursuant to the state Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach li City Council have had separate public hearings relative to Zone Case No. 80-14 wherein both bodies have carefully considered j all information presented at said hearings, and after due con- sideration of the findings and recommendations of the Planning Commission and all evidence presented to said City Council , the City Council finds that such zone change is proper, and consis- tent with the general plan, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows: SECTION 1. The followingdescribed realproperty, located li on the northwest corner of Bolsa Avenue and Springdale Street, is hereby changed from Ml-A, "Restricted Manufacturing District" to Ml-A-MS , "Restricted Manufacturing-Multistory District: " That portion of Section 9, Township 5 South, Range 11 West, partly in the Rancho Las Bolsas and partly in the Rancho La Bolsa Chica, in the city of Huntington Beach, County of r n e 0 a g , State of California, as per map re- corded in Book 51, page 13 of Miscellaneous j Maps , in the office of the County Recorder of said county, lying southerly and south- easterly of the southerly and southwesterly line of the right-of-way 75. 00 feet wide de- scribed in the deed to the United States of America, recorded December 9 , 1944 in Book 1296, /ahb 9/4/80 1. page 88, Official Records. Except that portion thereof lying northerly of the southwesterly and southerly line, and its easterly prolongation of the land described in the deed to the City of Huntington Beach, recorded April 17, 1963 in Book 6511 , page 659 , Official Records . Also except that portion thereof described in the deed to C. L. Peck-Robert S . Norman, a partnership, recorded October 25, 1965 in Book 6776, page 42 of Official Records . Also except that portion within the land described in the lease indenture between Dorothy T. Peck, et al. , and Douglas Aircraft Company, Inc. , a Delaware corporation, recorded July 27 , 1962 in Book 6192, page 606, Official Records. Also except therefrom an undivided one-half in- terest in and to all oil, gas , casinghead gas, and other hydrocarbon or mineral substances (all thereof hereinafter referred to as " reserved substances" ) in, under or that may be produced from said land, together with all rights incident thereto, including the exclusive right of ingress and egress at all times for the pur- pose of mining, drilling and exploring said land for said reserved substances and for the purpose of removing such reserved substances therefrom, particularly including the right of entry at any and all times upon and into any and all parts of the said land, below a depth of 500 feet from its surface, by slant or directional drilling from other land into and penetrating the said land below such depth of 500 feet from the surface thereof, but not including any right (and there shall be no right under such exception and reservation) of entry upon or use of the surface, or of the subsurface above a depth of 500 feet below the surface of any of said land, as reserved by Dorothy T. Peck Flynn, et al. , in the deed recorded January 18, 1966 in Book 7811, page 656 , Official Records . SECTION 2. The Development Services Director of the City of Huntington Beach is hereby directed to change District Map 9 (Sectional District Map 9-5-11) to incorporate the zone change 2. described in Section 1 hereof, and as said district map shall have been amended, the same shall be in full force and effect and be a part of the Huntington Beach Ordinance Code. A copy of said district map, as amended hereby, is available for inspection in the office of the City Clerk. SECTION 3. Section 9061, District Map 9 thereof, is hereby amended by Zone Case No. 80-14. SECTION 4. This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach Independent, a news- paper of general circulation.
