HomeMy WebLinkAboutOrdinance #2487 ORDINANCE NO. 2487 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTIONS 9700.16 , 9700. 19, AND 9730. 4 RELATING TO PRIVATE STREETS The City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The Huntington Beach Ordinance Code is hereby amended by amending sections 9700 . 16, 9700. 19, and 9730. 4 to read as follows : 9700. 16. Words beginning with the letters "P" and "Q" shall have the following definitions : (a) Parallel Parking. Parking which is immediately adja- cent to and parallel to the edge of a private or public roadway or driveway. (b) Planned Residential Development . A land development designed and developed as a unit for individual ownership of dwelling units or sites or air space rights in the area occu- pied by said dwelling units, with normal accessory residential uses, and permanently maintained common property with each resi- dent having an undivided interest in the common area for use as parks , waterways , golf courses , or other recreation areas that are integrated with the dwelling units for the sole enjoy- ment of residents within the development. ( c) Private club or lodge shall mean any facility or meeting place of an organization requiring bona fide membership. (d) Private street or roadway shall mean a privately owned and maintained roadway exceeding twenty-five ( 25) feet in width, which is primarily used to provide vehicle access from a public street or highway to the front, side or rear of two or more abutting private properties. 9700.19. Words beginning with the letter "U" shall have the following definitions : (a) Ultimate right-of-way shall mean the latest adopted maximum width for any street, alley or thoroughfare as estab- /ahb 4/22/81 1. lished by the Circulation Element of the General Plan, a precise plan of street, alley, or private street alignment, Department of Public Works standard plans or by recordation of a final or parcel map. 9730. 4. USE ABUTTING HIGHWAY, STREET, ALLEY OR PRIVATE STREET. INSTALLATION OF IMPROVEMENTS. (a) No certificate of occupancy shall be issued by the Department of Development Services until the abutting highway, street, or alley right-of-way has been improved to the centerline of such right-of-way. Said improvements shall include curbs, gutters , sidewalks , paving, street trees, street lights, street signs , street drainage and sewer and water main extensions in full compliance with the City of Huntington Beach street standards and requirements. (b) The Department of Development Services shall make a frame inspection as required by the Huntington Beach Building Code. At the time of the frame inspection, the off-site improve- ments, including curbs, gutters , and street paving shall be completed. ( c) The Department of Development Services shall not issue a building permit until the application for a permit and the street improvement plans and specifications have been submitted for plan check and the Department of Development Services is satisfied that the work described in the application for permit and the plans filed therewith conform to the requirements of the Huntington Beach Building Code and other pertinent laws and ordinances, and that the fee has been paid. (d) The Director of Public Works shall have the authority to grant a time extension for said off-site improvements in the event the developer cannot complete said improvements , and the delay is due to conditions beyond the control of the developer such as labor strikes , unobtainable materials, underground utility interference, etc. A time extension, if granted, shall be conditioned upon the developer' s posting a cash bond with the city in the amount of 110 percent of the estimated cost of said off-site improvements . SECTION 2. This ordinance shall take effect thirty days after adoption.
