HomeMy WebLinkAboutOrdinance #2502 ORDINANCE NO. 2502 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTIONS 9511.4 , 9511. 7 AND 9530. 4 PERTAINING TO INDUSTRIAL CONSTRUCTION IN MIXED USE DEVELOPMENTS The City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The Huntington Beach Ordinance Code is hereby amended by amending sections 9511. 4, 9511. 7 and 9530. 4 to read as follows : 9511.4 . CONDITIONAL USE PERMIT. WHEN REQUIRED. Commercial, service and office uses in conjunction with an industrial de- velopment shall only be permitted after review and approval of a conditional use permit. The conditional use permit application shall pertain to the entire development site for the total project being proposed, and shall be required to be approved prior to issuance of building permits whether for initial construction or interior alterations. A proposed listing of commercial, service, and office uses to be operated within the project, unless spe- cifically amended, shall be required concurrently with submittal of the original conditional use permit application for the entire project. The purpose of the proposed listing is to establish a theme of comprehensive and harmonious uses which will be com- patible with existing or other proposed uses in the industrial development. Such listing of categories of uses shall be approved by resolution of the Planning Commission prior to approval of the conditional use permit for a mixed use development, and the listing shall also specify those structures as shown on the site plan where such uses shall be located. The resolution of approval shall be kept on file in the Department of Development Services for reference purposes to limited uses . 9511.7 . PERFORMANCE STANDARDS BY PROJECT MANAGEMENT. The following measures shall be promulgated by project management prior to occupancy of any building in a mixed use development : f (a) Covenants, Conditions and Restrictions : All uses in the project shall be subject to one comprehensive and permanent set of covenants , conditions and restrictions which shall de- /ahb 6/24/81 1. Clare limitations on the mixed use entitlement, including the uses permitted and any conditions of approval attached to the conditional use permit application. All development, perform- ance and management standards shall also be included in the covenants, conditions and restrictions . Such covenants, condi- tions and restrictions shall be subject to review by the Department of Development Services for approval as to content, and approval as to form by the City Attorney. Modifications to approved covenants , conditions and restrictions may be made only after such modifications have been submitted for review and ap- proval by the city in its sole judgment. The latter stricture shall only apply to covenants, conditions and restrictions for mixed use developments. (b) Construction by Phases : A development may be con- structed in phases provided that the initial construction shall consist of 25 percent of the industrial uses to be developed. Projects consisting of at least 500,000 square feet of gross floor area may be constructed in phases provided that the initial construction shall consist of 5 percent of the total floor area or 50, 000 square feet, whichever is larger, of the industrial use. 9530.4 . PERFORMANCE STANDARDS BY PROJECT MANAGEMENT. SECTION 2. This ordinance shall take effect thirty days after adoption.
