HomeMy WebLinkAboutOrdinance #2507 ys% ORDINANCE NO. 2507 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH MUNICIPAL CODE BY REPEALING SECTIONS 2.04.010, 2.04.050 AND 2.04. 090 , AND ADDING THERETO CHAPTER 2.05 REGULATING CAMPAIGN CONTRIBUTIONS AND THE RE- PORTING OF LATE CAMPAIGN CONTRIBUTIONS The City Council of the City of Huntington Beach does ordain as follows : SECTION 1. Sections 2. 04.0101 2. 04. 050 and 2. 04.090 of the Huntington Beach Municipal Code are hereby repealed. SECTION 2. The Huntington Beach Municipal Code is hereby amended by adding thereto new Chapter 2.05 entitled, "Limitations on Campaign Contributions and Reporting of Late Campaign Contri- butions" to read as follows : 2.05.010 Definitions. Unless the context otherwise re- quires , the definitions set forth in Chapter 2 of Title 9 of the California Government Code (Political Reform Act) shall govern the interpretation of this chapter. 2.05.020 Limitations on contributions--Individual. No con- tributor shall make contributions in support of any candidacy or to any controlled committee with respect to any election which, in the aggregate , exceed $300 . 2 .05.030 Limitations on contributions--Independent committee (PAC) . No independent committee (PAC) shall make contributions or expenditures in support of the election of any candidate or to any controlled committee with respect to any election which, in the aggregate, exceed $1500 . 2 .05.040 Reporting of late contributions. Notwithstanding the limit contained in California Government Code section 820361, late expenditures or contributions in excess of 200 shall be re- ported to the city clerk within forty-eight (48) hours of the contribution or expenditure. 2 .05.050 Calendar year. Expenditures or contributions made within the period of twelve (12) months prior and subsequent to any election are considered to be made in support of a candidacy at I GH:ahb 9/22/81 1. (16) such election. 2. 05. 060 Review of campaign statements. The city clerk shall receive and review each campaign contribution and expendi- ture statement and report apparent violations of this chapter to the city attorney. 2. 05. 070 Severance. If any part of this chapter is held by a court of competent jurisdiction to be unenforceable for any rea- son whatsoever, then such part shall be deemed severed from the remainder of the chapter and the remainder shall thereafter re- main in full force and effect. Nothing in this chapter shall be deemed to place any limit upon any contribution given or expendi- ture made by any candidate in support of his own election. 2. 05. 080 Penalty--Misdemeanor. It is unlawful for any per- son knowingly to violate any provision of this chapter. Any such person shall be guilty of a misdemeanor and shall be subject to a fine of not more than five hundred dollars ($500) or imprison- ment in the county jail for a period not to exceed one hundred eighty (180) days , or both such fine and imprisonment. SECTION 3. This ordinance shall take effect thirty days after its adoption.
