HomeMy WebLinkAboutOrdinance #2518 ORDINANCE N0. 2518 AN INTERIM URGENCY ORDINANCE OF THE CITY OF HUNTINGTON BEACH EXTENDING THE MORATORIUM ON ISSUANCE OF LICENSES AND PERMITS FOR NEW BUSI- NESSES PROVIDING ADULT ENTERTAINMENT IN THE CITY WHEREAS, by Ordinance No. 2478, adopted March 2, 1981, the City Council placed an eight-month moratorium on the accep- tance and processing of applications for business licenses and permits for new businesses offering adult entertainment so that appropriate zoning regulations and standards for locating such businesses could be formulated; and The City Council finds it necessary to extend such mora- torium in order to allow the Department of Development Services and Planning Commission to complete their research and recommend- ation for an ordinance regulating the zoning and conduct of such adult entertainment businesses; and Notice pursuant to Government Code section 65856 having been I given, and public hearing having been held, the City Council finds that this urgency measure is necessary to protect the public health, safety and welfare so that the Department of Development Services and Planning Commission may complete their research and recommend- ation for an ordinance setting forth appropriate zoning regula- tions and standards for adult entertainment businesses, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows: SECTION 1. The moratorium heretofore placed on the accep- tance and processing of applications for business licenses and per- mits for new businesses providing adult entertainment is hereby extended for one ( 1) year; provided that such moratorium shall automatically terminate on the effective date of an ordinance ahb 9/10/81 1. ( 6 votes) establishing zoning regulations and governing the conduct of such businesses in the city of Huntington Beach. SECTION 2. This ordinance is hereby declared to be an ur- gency measure for the immediate preservation of the general public peace, health, safety and welfare and is deemed necessary to provide sufficient time for the Department of Development Services and the Planning Commission to complete their research and rec- ommend an ordinance to regulate the zoning and conduct of adult entertainment businesses in this city. This ordinance shall be in full force and effect upon adoption. SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause same to be published within fifteen days of its adoption in the Huntington Beach Independent, a news- paper of general circulation in the city of Huntington Beach.
