Home My WebLink AboutOrdinance #2549 ORDINANCE N0 . 2549 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR CHANGE OF ZONING FROM OFFICE PROFESSIONAL TO HIGHWAY COMMERCIAL DISTRICT ON REAL PROP- ERTY GENERALLY LOCATED ON THE NORTH SIDE OF WARNER AVENUE, EAST OF BOLSA CHICA STREET (ZONE CASE NO . 82-1) WHEREAS, pursuant to the state Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach City Council_ have had separate public hearings relative to Zone Case No. 82-1 wherein both bodies have carefully considered all information presented at said hearings, and after due con- sideration of the findings and recommendations of the Planning Commission and all evidence presented to said City Council, the City Council finds that such zone change is proper, and consis- tent with the general plan, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The following described real property, generally located on the north side of Warner Avenue, east of Bolsa Chica S treet, is hereby changed from R5, "Office Professional District" to C4, "Highway Commercial District: " The westerly 124. 00 feet of the easterly 284.00 feet of that portion of Lot 4 in Block 5 of Tract No . 86 , as shown on a map recorded in Book 10, pages 35 and 36, Miscellaneous Maps , records of Orange County, California, described as follows: Beginning at a point in the easterly line of said Lot 4, distant thereon southerly 310 .43 feet from the northeast corner of said lot; thence southerly along said easterly line and the southerly ex- tension thereof, a distance of 350.00 feet to the ahb 2/3/82 1. \ S centerline of Wintersburg Avenue, as shown on the map of said Tract No. 86; thence westerly along said centerline, a distance of 284. 00 feet to the southeast corner of the land de- scribed in Parcel l in deed to Dale E. Heckman and wife, recorded June 21, 1957 in Book 39501, page 280 of Official Records ; thence northerly along the easterly line of said land of Heckman a distance of 330. 38 feet, more or less, to the southerly line of the land described in a deed to Delbert E. Schell and wife, recorded November 20, 1946 in Book 1458, page 529 of Official Records ; thence easterly along said southerly line, a distance of 16 .16 feet to the southeast corner of said land of Schell; thence northerly, along the easterly line of said land of Schell, a distance of 19.57 feet to the southerly line of the land described in Parcel 3 in the deed to Darrell W. King and others , re- corded July 10, 1948 in Book 1667 , page 190 of Official Records , thence easterly along said II southerly line, a distance of 267. 68 feet , to the point of beginning. ik EXCEPTING THEREFROM that portion described as follows: Beginning at the southeast corner of the land de- scribed in a deed to Delbert E. Schell and wife, recorded November 201 1946 in Book 1458, page 529 of Official Records , thence easterly parallel with the northerly line of said Lot 4, a distance of 17 feet; thence- southerly parallel with the westerly line of said lot, a distance of 12 feet ; thence westerly parallel with the northerly line of said lot, a distance of 22 feet; thence northerly parallel with the westerly line of said lot, a distance of 12 feet; thence easterly parallel with the northerly line of said lot, a distance of 5 feet to the point of beginning. Also known as Parcel 1 of a parcel map recorded in Book 3 , page 31 of Parcel Maps , Records of Orange County, California . SECTION 2. The Development Services Director is hereby di- rected to amend Section 9061 , District Map 24 (Sectional District Map 21-5-11 ) to reflect Zone Case No. 82-1 , described in Sec- tion 1 hereof. A copy of said district map , as amended hereby is 2. available for inspection in the office of the City Clerk. SECTION 3. This ordinance shall take effect thirty days after its adoption.
