HomeMy WebLinkAboutOrdinance #2607 ORDINANCE NO. 2607 AN URGENCY ORDINANCE OF THE CITY OF HUNTINGTON BEACH IMPOSING AN INTERIM ORDINANCE TO REGULATE PARKING PROVISIONS ON REHABILITATION AND NEW DEVELOPMENT IN THE COASTAL ZONE OF THE CITY OF HUNTINGTON BEACH WHEREAS, the city has been developing the Downtown Specific Plan for one and one-half years to set forth new development regulations in the downtown area of the Coastal Zone which will require development to provide parking pursuant to Article 979 of the Huntington Beach Ordinance Code; and The city' s Land Use Plan has been approved by the Coastal Commission and the specific plans for the area are pending final revision of Environmental Impact Report No. 82-2 before spec- cific plan standards can be adopted; and The existing zoning (C3) in a portion of said area requires less than 50 percent of the parking anticipated under the new specific plan and for developments elsewhere in the city, and revitalization need not comply even with those minimum standards ; and The specific plan will have to be certified by the Coastal Commission prior to the city' s being authorized to issue develop- ment permits within the Coastal Zone; and Pursuant to California Government Code section 65858, a public hearing is not required, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as followd SECTION 1. All uses permitted and/or proposed in the Downtown Specific Plan District shall provide offstreet parking pursuant to the provisions of Article 979 except that upon any new construction, renovation which is in excess of $30,000, or AJF:ahb 1/17/83 ( 5) 1. i upon a change of use in the property, the property owner and/or developer may pay an "in-lieu" fee for providing required parking in a parking structure . Said fee may be paid in two installments. The first installment in the amount of $3,650 per parking space shall be paid prior to the issuance of building permits or of a certificate of occupancy, whichever comes first . The second in- stallment in the amount of $6,850 per parking space shall be paid at the time city and/or a parking authority or district con- structs a parking structure in the downtown area. A surety in a sum equal to the second installment shall be filed with the city at the time the first installment is paid. SECTION 2. This ordinance is hereby declared to be an ur- gency measure for the immediate preservation of the health, safety, and welfare of the community and to lessen impacts on street congestion, parking, and circulation in said area and until the Department of Development Services and Planning Commission can develop viable proposals and recommendations which can be imple- mented by a specific plan setting forth development standards in the area. SECTION 3. This ordinance shall take effect immediately and in accordance with Government Code section 65858, is of no further force and effect forty-five days from the date of its adoption. The City Clerk shall certify to the passage of this ordinance and shall cause same to be published within fifteen days of its adoption in the Huntington Beach Independent, a newspaper of general circulation.
