HomeMy WebLinkAboutOrdinance #2614 ORDINANCE NO. 2614 AN URGENCY ORDINANCE OF THE CITY OF HUNTINGTON BEACH TO REGULATE PARKING PROVISIONS ON REHABI- LITATION AND NEW DEVELOPMENT WITHIN THE COASTAL ZONE OF THE CITY WHEREAS, the city has been developing the Downtown Specific Plan for one and one-half years to set forth new development regulations within the downtown area of the Coastal Zone which will require development to provide parking pursuant to Article 979 of I the Huntington Beach Ordinance Code ; and The city's Land Use Plan has been approved by the Coastal Commission and the specific plans for the area are pending final revision of Environmental Impact Report No . 82-2 before specific plan standards can be adopted; and The existing zoning (C3) within a portion of said area requires less than 50 percent of the parking anticipated under the new specific plan, and for developments elsewhere in the city, and revitalization need not even comply with those minimum standards ; and The specific plan will have to be certified by the Coastal Commission prior to city's being authorized to issue development permits within the Coastal Zone, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows : SECTION 1 . The Huntington Beach Ordinance Code is hereby amended by repealing sections 9456, 9456.1, 9456. 2 and 9456. 3. SECTION 2. The Huntington Beach Ordinance Code is hereby amended by adding thereto new sections 9456 and 9456. 1 to read as follows : 9456. OFFSTREET PARKING. All uses permitted in this district shall provide off-street parking. The arrangement, access, size, and number of all such parking spaces and/or lots shall conform to Article 979, except that said requirement may be satisfied by one of the following: AJF:ps 1. 3/16/83 (a) Off-street parking spaces shall be provided and may be located within three hundred (300) feet of the premises they are intended to serve provided such off-street parking facility is under the same ownership as the premises served; or (b) The property owner shall enter into an agreement with the City of Huntington Beach that will bind him and/or his successor(s) in interest in the subject property to pay a fee in lieu of the required parking pursuant to the application of this section . The amount of said fee is to be established by the City Council at the time of a formation of a publicly administered parking district , at which time the payment is due . Said fee shall not exceed $15, 000 per parking space . Instead of entering into this agreement, the property owner may post a security in the amount of $10, 500 per required parking space . This security shall be returned on the formation of a public district, as long as the property for which the security has been posted is within the parking district and provided that the parking district makes provisions for appropriate assessments of said property. (c) Government Code section 66499 shall govern the furnishing of security pursuant to this section . 9456.1 OFF-STREET PARKING REQUIREMENTS. APPLICATION OF. Off-street parking requirements shall apply to the following: (a) The construction of new buildings ; or (b) Renovation of exceeding 50 percent of the floor area of an existing building; or (c) Establishment of a new use which requires more parking than the previously established use in the building. SECTION 3. This is an urgency ordinance necessary for the immediate preservation of the health, safety, and welfare of the community and is required to lessen impact on street congestion, parking and circulation in said area so that the Department of Development Services and Planning Commission can develop viable proposals and recommendations which can be implemented by a specific plan setting forth development standards in the area. This parking ordinance shall terminate upon adoption of the aforementioned specific plan. 2 . SECTION 4. This ordinance shall take effect immediately and, in accordance with Gover-umgnt_ Code section 65858, is of no further force and effect ten months and fifteen days from the date of its adoption . The City Clerk shall certify to the passage of this ordinance and shall cause same to be published within fifteen days of its adoption in the Huntington Beach Independent, a newspaper of eneral circula- tion . u-TIM ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 21st day of March 1983.
