AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY REPEALING ARTICLE 979 AND ADDING A NEW
ARTICLE 979 PERTAINING TO OFFSTREET PARKING
AND LANDSCAPING
The City Council of the City of Huntington Beach does ordain
as follows :
SECTION 1. The Huntington Beach Ordinance Code is amended by
repealing Article 979 and adding a new Article 979 to read as
follows :

9791. 1 PURPOSE. In order to prevent traffic congestion and
shortage of curb spaces, off-street parking facilities shall be
provided incidental to new uses and major alterations and enlarge-
ments of existing uses. The parking facilities required by this
section for motor vehicle parking and maneuvering are assumed to be
the minimum need for such facilities created by each particular
land use . Off-street parking is to be laid out in a manner that
will ensure its usefulness, protect the public safety, and, where
appropriate , insulate surrounding land uses from its impact.
9791. 2 PARKING SPACES REQUIRED. In connection with the use
of each parcel of land, sufficient off-street parking spaces shall
be provided to meet the demand created by all activities on the
parcel . The minimum requirements for each use shall be shown as in
the following table entitled REQUIRED PARKING BY USE (Section
9791. 12 ) . Additional parking space requirements may be required
based upon substantial estimates, as a condition of approval of a
development requiring discretionary action by a decision making
body.
9791. 3 REQUIREMENT FOR USES NOT SPECIFIED. Where the parking
requirements for a use are not specifically set forth in this
chapter, the parking requirements for such use shall be determined
by the Director of Development Services or the Planning Commission
or the Board of Zoning Adjustments, and such determination shall be
based on the requirements for the most comparable structure or use
specified.

9791. 4 REQUIREMENT FOR FACILITIES NOT SPECIFIED. Any off-
street parking or loading facility which is permitted but not
required by this chapter shall comply with all provisions of this
chapter governing the location, design, improvement, and operation
of such facilities.
9791. 5 REQUIREMENT FOR MIXED OCCUPANCIES. In the case of
mixed uses or occupancies within a development, the total number of
required off-street parking spaces shall be the sum of the number
required for each use, except as provided through joint use
provisions.
9791. 6 REQUIREMENT FOR CHANGE IN USE. When the use of any
structure or premises is changed to a different use having a higher
parking requirement, additional parking shall be provided to meet
the new requirements prior to the issuance of a new certificate of
occupancy. Additional parking to meet the requirements of this
section shall be provided for the enlarged or expanded portion
only. No additional parking shall be required where the total
number of spaces prescribed for the addition, enlargement, or
change is less than ten ( 10 ) percent of the number of spaces
prescribed for the use as conducted prior to such addition,
enlargement, or change .
9791. 7 CERTIFICATE OF OCCUPANCY. A certificate of occupancy
for any structure or premises shall not be issued until all of the
required parking and loading facilities for the use have been
completed in conformance with the requirements of this chapter.
9791. 8 LOCATION OF PARKING FACILITIES. Required parking
shall be located on the same lot as the activities or uses served,
except as follows :
A. Required parking may be located on a lot adjacent to the
lot served subject to a recorded covenant running with the land
which h owner of the parking facility ich shall be recorded by the o e p g y
guaranteeing to the city that the required parking will be main-
tained for the life of the use or activity served.
B. Any required parking provided by means of a parking dis-
trict is not subject to a specific location requirement.
9791. 9 SITE DEVELOPMENT STANDARDS. The design and layout

of parking areas shall meet the standards contained in the
following subsections and shown in Diagrams A-F attached.
9791. 9. 1 Circulation Design. Commercial, industrial, and
residential off-street parking spaces shall have access to a public
III street or alley and shall be provided with internal circulation,
safe entrances and exits, drives, and aisles consistent with city
standards. Parking spaces designed so that it is necessary to back
directly into a public street shall be prohibited, except for
residential garages and carports serving single-family dwellings
and duplexes. Traffic circulation shall

be designed to ensure that no vehicle need enter a public street in
order to progress from one aisle to any other aisle within the same
development.
9791. 9. 2 Commercial Center Entrance. Commercial centers
which have 200 parking spaces or more shall have at least one main
entrance designed to the specifications shown in Diagram G.
9791. 9. 3 Concrete Curbs. Continuous concrete curbs shall be
used to separate parking from landscaped planter areas.
9791. 9. 4 Corner Cut-off - Buildings Adjacent to Intersecting
Driveways. Where a building is adjacent to the intersection of two
driveways or a driveway and an alley, a 10-foot corner cut-off
shall be provided for visibility.
9791. 9. 5 Drainage. Parking facilities shall be prepared,
graded, and paved in such a manner to ensure that all surface
waters will drain into a public street, alley, or storm drain, or
any other drainage system approved by the Department of Public
Works.
9791. 9. 6 Directional Signs. Directional signs or markings
shall be provided in all facilities in which one-way traffic has
been established.
9791. 9. 7 Driveway Locations on Arterial Highways. Driveway
locations on arterial highways shall be located to coordinate with
future median openings in accordance with the design standards
established by the Department of Public Works.
9791. 9. 8 Drive-Thru Facilities. Commercial establishments
with drive-thru windows may be allowed a stacking credit reducing
the amount of required off-street parking subject to the approval
of the Director of Development Services, Board of Zoning Adjust-
ments, or Planning Commission. The stacking credit shall be
allotted at the ratio of one ( 1 ) space for each twenty-three (23 )
lineal feet of drive-up lane area not to exceed thirty ( 30 ) per-
cent of the total number of required off-street parking spaces for
the use or twenty ( 20 ) parking spaces, whichever is less. Each
drive-up lane shall be a lane separate from the circulation routes
and lanes necessary for ingress to or egress from the property, or
access to any off-street parking space. Each such lane shall be
striped, marked, or otherwise distinctly delineated.
9791. 9. 9 Driveway Standards. The paved surface of driveways
and drive entrances shall comply with Standard Plans on file with
the Department of Public Works.

9791. 9. 10 Illumination. All parking area lighting shall be
energy efficient and arranged so as not to produce glare on ad-
jacent residential properties. Security lighting shall be provided
in parking areas accessible to public entry after dark.
9791. 9. 11 Parking Space Dimensions. Each off-street parking
space shall consist of a rectangular area not less than nine ( 9 )
feet wide by nineteen ( 19 ) feet long, except for spaces allowed
under the compact car sections of the code . Any end space adjacent
to a wall more than twelve ( 12 ) inches in height shall have an
additional three ( 3 ) feet of width.
9791. 9. 12 Pavement Surface Standards. The entire surface
devoted to vehicular or pedestrian traffic shall be paved in
accordance with "Standard Specifications for Public Works Construc-
tion" on file in the Department of Public Works.
9791. 9. 13 Physical Protection for Fencing. Fences or walls
which are adjacent to parking areas shall be protected from vehicle
damage by a method acceptable to the Director of Development
Services.
9791. 9. 14 Striping. All off-street parking spaces shall be
outlined by painted stripes on the surface area in the manner
described in Diagram F.
9791. 9. 15 Tandem Parking. Tandem parking for required off-
street parking spaces shall be prohibited.
9791. 9. 16 Landscaping Within Parking Lots. Landscaping
within parking lots shall be provided in compliance with standards
in Section 9792 "Landscaping. "
9791. 10 COMPACT CAR PARKING. Compact car parking may be used
to satisfy a portion of the required parking for commercial, indus-
trial, and residential uses, subject to the provisions of this
article .
9791. 10. 1 Compact Car Parking Allocation. Commercial or
industrial developments with twenty ( 20) or more parking spaces may
be allowed a maximum of forty (40 ) percent compact car parking.
Multi-family residential developments with 100 units or more may be
allowed twenty (20 ) percent of open guest parking spaces as compact
car parking, provided that:
Compact car parking is a workable alternative to standard
parking through design and layout and is not likely to result in
unnecessary traffic congestion; and
An equitable system of assignment and distribution of parking
stalls for compact cars has been established.

9791. 10. 2 Compact Car Parking Space Dimensions. The minimum
size of compact car stalls shall not be less than eight (8 ) feet in
width and fifteen (15 ) feet in length.
9791. 11 JOINT USE PARKING STANDARDS. The Board of Zoning
Adjustments or Planning Commission may grant through the application
process a reduction in the total number of required off-street
parking spaces, when it can be shown that the parking facilities have
divergent needs on the basis of non-use by one user during a period
of use by another. This basis of use versus non-use must be in
relation to nighttime versus daytime hours or weekdays in relation to
weekend needs, subject to the following:
9791. 11. 1 The location and walking distance from the parking
facility to said building or use . Under no circumstances shall the
walking distance from the nearest point of the parking facility to
the building or use exceed two hundred fifty ( 250 ) feet.
9791. 11. 2 The applicant shall show to the satisfaction of the
Board or Commission that there is no conflict in the principal
operating hours of the buildings or uses for which the joint parking
facilities are proposed.
9791. 11. 3 The parties concerned in the joint use of off- street
facilities shall evidence an agreement for such joint use by proper
legal instrument approved by the City Attorney as to form and
content. Such instrument when approved shall be recorded in the
office of the County Recorder and a copy filed with the Department of
Development Services.
9791. 12 REQUIRED PARKING BY USE. The following uses shall
provide off-street parking facilities to at least the minimum
standards required in this section:

Note: For Parking Lots Over 200 Spaces
9792. 10 EXCEPTION. Developments approved prior to the
effective date of this ordinance shall comply with the landscape and
screening standards effective June 7, 1983, which requires a minimum
of six ( 6 ) percent of the site be landscaped with a six (6 ) foot
wide ( inside dimension ) landscaped planter located along the street
side property line. Along the designated landscape and scenic
corridors reflected in exhibit "B" hereto, the requirement is for a
ten ( 10 ) foot wide landscaped planter with six ( 6 ) percent of the
site landscaped. Existing developments that do not meet the June 7,
1983, standards shall be required to meet the standards in existence
June 7, 1983 at the time expansion and/or exterior modifications are
made to such developments.
9792. 11 LANDSCAPE AND SCENIC CORRIDORS. All developments
within designated landscape and scenic corridors reflected in
exhibit "B" hereto, shall comply with the requirement for a ten ( 10 )
foot landscaped berm along the arterial property line .
SECTION 2. This ordinance shall take effect thirty days after
adoption.

9792 LANDSCAPING
9792. 1 PURPOSE. The purpose of this section is to provide
minimum standards for landscaping in order to improve the aesthetic
qualities of the city.
9792. 2 PERCENTAGE OF LANDSCAPING. A minimum of eight ( 8 )
percent of the site shall be landscaped. Said landscaped areas shall
be determined by calculating eight ( 8 ) percent of the net area of the
total site.
9792. 3 FRONT AND EXTERIOR SIDE YARDS. Subject to approval of
landscape and irrigation plans by the Department of Development
Services and the Department of Public Works, a ten ( 10 ) foot wide
( inside dimension) landscaped berm shall be provided along the front
and exterior side lot lines except for driveway openings. Said berm
shall be at least twenty ( 20 ) inches high. Typical berming is
depicted in Diagram A.
(a) Any screening wall shall be placed behind the landscaped
area. Walls shall be set back five ( 5) feet from the edge of a
driveway or alley.
(b) One (1 ) fifteen (15 ) gallon minimum size tree for each
twenty-five (25 ) linear feet of property line shall be located within
the planter area along the property line adjacent to any street.
Trees may be clustered. A minimum of seventy-five ( 75 ) percent of
the shrubs not used as a ground cover shall be of a minimum five ( 5)
gallon size . Ground cover areas shall be planted with well rooted
cuttings or container stock. Turf areas shall be planted with field
grown established sod. Planting shall be harmonious with the
architectural design and site location.
(c ) All landscaping within five ( 5 ) feet of a public right-of-
way shall be subject to the approval of the Department of Public
Works in accordance with the latest landscaping standards.
(d) Pedestrian walkways, not to exceed five ( 5 ) feet in width,
may be permitted across the landscaped area. Said walkways shall not
be closer than intervals of fifty ( 50 ) feet.
9792. 4 INTERIOR LANDSCAPING. One (1 ) fifteen (15) gallon
tree for each ten ( 10 ) parking stalls shall be placed throughout the
off-street parking area. Distribution of such trees shall be subject
to the approval of the Director of Development Services. Boundary
area trees located in front and exterior side yards shall not be
counted toward this requirement.

9792. 5 IRRIGATION. All landscaped areas shall be provided
with an electric automatic irrigation system. The irrigation system
shall be designed to provide complete and adequate coverage to sus-
tain and promote healthy plant life . In no case shall an irrigation
system cause water to spray upon or flow across a public sidewalk.
9792. 6 PHYSICAL PROTECTION FOR LANDSCAPING. All landscaping
shall be protected from vehicular and pedestrian damage by a six ( 6 )
inch high by four ( 4 ) inch wide curb of portland cement. Additional
protection shall be provided by one of the following:
(a) Concrete wheel bumpers
(b) An additional two and one-half (2-1/2) feet of landscaping
may be provided between a parking stall and the required landscaped
area. Such method will reduce the length of the parking stall from
nineteen ( 19 ) feet to sixteen (16 ) feet six ( 6 ) inches but will allow
a vehicle to extend over the additional landscaped area. The addi-
tional landscaping, consisting of low-growing shrubs, ground cover,
or a combination thereof, shall not be included when calculating the
total ten (10 ) percent of landscaping required.
(c) Any method or design which is acceptable to the Director.
9792. 7 HEIGHT OF FRONT AND EXTERIOR BOUNDARY LANDSCAPING.
For traffic safety vision, the height of all front and exterior
boundary landscaping within five ( 5 ) feet of an alley or drive shall
not exceed thirty-two ( 32 ) inches. Measurement of said five ( 5) feet
shall be taken from the entrance or exit points of the alley or
drive.
9792. 8 MAINTENANCE. All landscaping shall be maintained in a
neat, clean and healthy condition . Maintenance shall include proper
pruning; mowing of lawns; pest, disease and rodent control; weeding;
removal of litter; fertilizing; replacement of plants when necessary;
and regular watering.
9792. 9 COMPLIANCE OF LANDSCAPE PLAN. The landscape plan
shall comply with the "Landscape Construction Submittal Requirements"
which is on file in the Department of Development Services. The
landscape plan shall be consistent with the submitted grading plan.
